I would like to ask, for foreign workers who have terminated their employment contract, whose work permit has been expired and cannot be renewed, if they wish to receive their lump-sum social insurance, what are required procedures and documents?

According to the provisions in point d, clause 6, Article 9 of Decree No. 143/2018/ND-CP dated October 15, 2018, of the Government, which provides guidance on the Law on Social Insurance and the Law on Occupational Safety and Hygiene  regarding compulsory social insurance for foreign workers working in Vietnam. Foreign workers who submit a request are entitled to receive a lump-sum social insurance payment while terminating their labor contract or when their work permit, professional certificate, or practicing license expires without being extended.

The application for a lump-sum social insurance payment for foreign workers is specified in clause 1, Article 15 of Decree No. 143/2018/ND-CP and clauses 1 and 2, Article 109 of the 2014 Social Insurance Law:

- The social insurance book; 

- A completed application form for the lump-sum social insurance benefit (Form 14-HSB bilingual in Vietnamese and English). 

- Based on clause 3, Article 15 of Decree No. 143/2018/ND-CP dated October 15, 2018, of the Government, the submission deadline must be within 10 days counting to the date of termination of a labor contract or the date of expiration of a work permit, practice certificate or practice license (whichever comes first), if an employee no longer works under the labor contract or his/her permit/certificate/license cannot be extended, he/she may request lump-sum social insurance allowance and shall submit a dossier made under regulations to the social security offices.
