Do foreigners who have worked and contributed to social insurance in Vietnam for 5 years are entitled to a lump-sum insurance after terminating their labor contract? What documents are needed for the application?
Point 6 of Article 9 of Decree No. 143/2018/ND-CP dated October 15, 2018, of the Government details the Social Insurance Law and the Law on occupational safety and hygiene regarding compulsory social insurance states that foreign workers in Vietnam who are subject to compulsory social insurance and make a request are entitled to receive a lump-sum social insurance payment when terminating their labor contract or when their work permit, professional certificate, or practicing license expires without renewal.
The documentation required for the lump-sum social insurance payment is specified in Article 109 of the Social Insurance Law of 2014, which includes:
- Social insurance book;
- Application for lump-sum social insurance payment (Form No. 14-HSB attached to Decision No. 686/QD-BHXH dated May 29, 2024, of Vietnam Social Insurance).
