Who is subject to work injury and occupational disease benefits?

The subject of the application of the occupational accident and disease insurance regime is specified in Article 43 of the Law on Occupational Safety and Hygiene and Clause 1 of Article 2 of Decree No. 143/2018/ND-CP dated October 15, 2018, of the Government detailing the Social Insurance Law and the Law on Occupational Safety and Hygiene regarding compulsory social insurance for foreign workers in Vietnam, specifically as follows:

- Individuals working under indefinite-term labor contracts, definite-term labor contracts, seasonal labor contracts, or contracts for a specific job with a duration of between 3 months and less than 12 months, including contracts signed between the employer and the legal representative of individuals under 15 years old as per labor law;

- Individuals working under labor contracts with a duration of between 1 month and less than 3 months;

- Officials, civil servants, and public employees;

- Defense workers, police workers, and others working in cryptographic organizations;

- Officers and professional soldiers of the people's army; officers and non-commissioned officers in professional technical roles in the people's police; individuals working in cryptographic tasks receiving salaries equivalent to military personnel;

- Non-commissioned officers and soldiers of the people's army; non-commissioned officers and soldiers of the people's police serving for a limited time; military and police students receiving living allowances

- Business managers and cooperative managers receiving salaries;

- Foreign workers in Vietnam who are subject to compulsory social insurance when holding a work permit or professional certificate or practicing license issued by the competent authority of Vietnam and have indefinite-term labor contracts or definite-term labor contracts of 1 year or more with employers in Vietnam.

Employers participating in compulsory social insurance include state agencies, public units, armed forces units; political organizations, socio-political organizations, socio-professional political organizations, socio-professional organizations, other social organizations; foreign agencies, organizations, international organizations operating in Vietnam; enterprises, cooperatives, individual business households, cooperative groups, other organizations, and individuals who hire or use labor under labor contracts

In cases when workers enter into labor contracts with multiple employers, the employer must pay for occupational accident and disease insurance according to each labor contract that has been signed if the worker belongs to the group required to participate in compulsory social insurance.
