Position and functions

The Vietnam Social Security (VSS) is a State agency subordinate to the Government. It performs the functions of implementing social and health insurance benefits and policies; collecting and paying unemployment insurance; managing and using social, unemployment and health insurance funds; and carrying out inspections of the payment of social, unemployment and health insurance premiums under legal regulations.

Tasks and power

  1. Proposing the Government regulate the functions, tasks, power and apparatus of the VSS.
  2. Submitting to the Prime Minister development strategies for the social security sector, including long-term, five-year and annual plans on the VSS’s activities, projects on preserving and developing the social, unemployment and health insurance funds after they are approved by the VSS Management Council; and implementing strategies, plans and projects after they are approved.
  3. The VSS’s responsibilities and relations with ministries in charge of State management of social, unemployment and health insurance, and financial regimes for the social, unemployment and health insurance funds: To the Ministry of Labour, War Invalids and Social Affairs: Proposing the building, amendment and supplementation of social and unemployment insurance benefits and policies; proposing inspections and examinations of organisations and individuals’ implementation of social and unemployment insurance regulations. The VSS is subject to inspections and examinations by the Ministry of Labour, War Invalids and Social Affairs over the implementation of legal regulations on social and unemployment insurance. It has to make annual and unscheduled reports to the Ministry of Labour, War Invalids and Social Affairs on the implementation of social and unemployment insurance benefits and policies, and the collection, spending, management and use of the social and unemployment funds. To the Ministry of Health: Proposing the building, amendment and supplementation of health insurance benefits and policies; joining the Ministry of Health in determining health insurance premiums, interests and levels of benefits for those who receive medical examination and treatment under health insurance, mechanisms for paying medical examination and treatment expenses, and healthcare service prices and lists of medicines, medical equipment and technical services covered by health insurance. The VSS is enabled to propose the Ministry of Health inspect and examine organisations and individuals in the implementation of health insurance under legal regulations. The VSS is subject to inspections and examinations by the Ministry of Health in implementing legal regulations on health insurance and makes annual and unscheduled reports to the Ministry of Health on the implementation of health insurance benefits and policies, and the collection, spending, management and use of the health insurance funds. To the Ministry of Finance: Proposing the building, amendment and supplementation of financial regimes for the social, unemployment and health insurance funds and the financial mechanism for the VSS. The VSS is subject to inspections and examinations by the Ministry of Finance in terms of implementing legal regulations on financial regimes for the social, unemployment and health insurance funds. It has to make annual and unscheduled reports to the Ministry of Finance on the collection, spending, management and use of the social, unemployment and health insurance funds. Coordinating with the Ministry of Labour, War Invalids and Social Affairs, the Ministry of Finance, and the Ministry of Health in the management of collecting, spending, preserving, developing and balancing the social, unemployment and health insurance funds.
  4. Issuing documents instructing procedures and activities for handling social and health insurance benefits and policies, collecting and spending social, unemployment and health insurance in accordance with legal regulations, and issuing documents for the internal management of the VSS.                                                                              
  5. Organising the dissemination of information about benefits, policies and laws on social, unemployment and health insurance, and organising the exploitation, registration and management of those covered by social, unemployment and health insurance.
  6. Issuing social and unemployment insurance books and dossiers and health insurance cards; and granting social insurance books and health insurance cards to insurance buyers.                
  7. Collecting social and health insurance premiums paid by agencies, units, organisations, employers and individuals in accordance with legal regulations. Receiving funding from the State budget to spend on social and health insurance benefits.
  8. Receiving dossiers on and dealing with cases of maternity, sickness, work accidents, occupational diseases, retirement, death gratuity, recovery after sickness, maternity, treatment of work accidents and occupational diseases, and medical examination and treatment.
  9. Paying retirement pensions, work accident and occupational disease allowances, sickness allowances, maternity allowances, allowances for labour capacity loss, allowances for recovery after sickness, maternity, and treatment of work accidents and occupational diseases, death gratuity, and medical examination and treatment in a full, convenient and timely manner.
  10.  Collecting unemployment insurance premiums paid by agencies, units, organisations, employers and employees; paying unemployment benefits; helping persons receiving unemployment benefits to learn vocations, seek jobs and pay health insurance premiums.
  11.  Managing and using the social, unemployment and health insurance funds, which consist of the retirement pension and death gratuity fund, work accident and occupational disease fund, sickness and maternity fund, unemployment insurance fund, and health insurance fund, in line with the principles of centralism, consistency, openness, transparency and morality and recording social, unemployment and health insurance funds.
  12.  Organising the signing of contracts and supervising the implementation of contracts with authorised health clinics; inspecting procedures and quality of medical checkups and treatment with health insurance; assessing the use of medicines, chemicals, and medical equipment and services for patients; determining expenses for medical checkups and treatment with health insurance; protecting interests of health insurance participants; and preventing health insurance abuse.
  13.  Organising of the signing of contracts with agents authorised to collect social and health insurance premiums and agents permitted to pay social and unemployment insurance benefits.
  14.  Providing advice for social security offices of the Ministry of National Defence and the Ministry of Public Security and coordinating with social security offices of the Ministry of National Defence and the Ministry of Public Security in managing social and health insurance affairs within the two ministries.
  15.  Conducting inspections over the payment of social, health and unemployment insurance premiums, and punishing administrative violations.
  16.  Examining the signing of contracts and the payment of social, health and unemployment insurance in agencies, units and organisations using employees and individuals and health clinics; and rejecting the payment of social, health and unemployment insurance premiums and benefits in cases contrary to legal regulations.
  17.  Solving complaints and denunciations, having the right to lodge civil lawsuits requiring the court to protect the State’s and public’s legitimate interests in the fields of social, health and unemployment insurance.
  18.  Implementing international cooperation in social, health and unemployment insurance in line with legal regulations.
  19.  Managing the apparatus and personnel in public non-productive units; making decisions on the rotation, retirement, appointment, dismissal, commendation or discipline of officials and public servants; recruiting and using officials and public servants and their salary regimes.                                                                         
  20.  Managing finance and assets of the VSS system and compiling statistics and accounting of social, health and unemployment insurance in accordance with legal regulations.
  21.  Deciding and implementing administrative reform plans of the VSS following the Government’s plans, targets and requirements and the direction of the Prime Minister and implementing the one-stop-shop mechanism in handling social, health and unemployment insurance policies.
  22.  Conducting e-transactions in the fields of social, health and unemployment insurance in line with law.
  23.  Archiving records of people who participate in and are provided with social, health and unemployment insurance benefits.
  24.  Organising scientific research and application of information technology in statistics and management of social, health and unemployment insurance.
  25.  Organising training courses on social, health and unemployment insurance.
  26.  Submitting half-yearly reports to the VSS Management Council about the implementation of social, health and unemployment insurance. Every year, reporting to the Government on the management and use of the social, health and unemployment insurance funds.
  27.  Providing complete and timely information about the payment and the right to pay  social, health and unemployment insurance premiums and enjoy benefits when employees, employers or trade unions require. Providing relevant documents and information fully and promptly as required by authorised State offices.
  28.  Being updated with the use and change of labourers by local State management agencies every six months, as well as with tax codes of organisations and individuals by tax agencies every year.
  29.  Coordinating with State agencies, socio-political organisations at the central and local levels as well as parties involved in social, health and unemployment insurance in solving issues related to the implementation of social, health and unemployment insurance policies in line with law.
  30. Coordinating in conducting specialised inspections on social, health and unemployment insurance as required by authorised State agencies and proposing State agencies tackle violations of social, health and unemployment insurance regulations.
  31. Implementing other tasks and power assigned by the Government and the Prime Minister.                                                     International Cooperation Department
