Proposing to amend and supplement unemployment insurance policies in the direction of supporting enterprises and employees to maintain jobs and expand unemployment insurance participants

The Ministry of Labour, Invalids and Social Affairs has been proposing to develop the Labour Code (amended) to collect opinions from the people. Accordingly, it is proposed to amend and supplement unemployment insurance policies in the direction of supporting businesses and employees to maintain jobs; expand unemployment insurance participants; develop vocational skills towards a sustainable labor market, etc.

Completing unemployment insurance policy towards being a labor market management tool

The Ministry of Labor, War Invalids and Social Affairs said, regarding participation in unemployment insurance, the number of participants currently does not cover all subjects with labor relations; a number of regulations on participation in unemployment insurance need to be amended and supplemented to ensure conformity with reality, such as regulations on subjects to pay unemployment insurance premiums, management of subjects eligible to participate in unemployment insurance. It is the responsibility of the employer to immediately notify the labor agency and the social security agency of the employee's employment, so there is a case where the employee has a job and is still entitled to unemployment insurance, etc.

Expanding unemployment insurance participants

In order to amend and supplement unemployment insurance policies in the direction of supporting enterprises and employees to maintain jobs, bring into full play the functions of unemployment insurance, and ensure unemployment insurance is really a tool for labor market management, the Ministry Labor - Invalids and Social Affairs proposed to expand unemployment insurance participants; amend 04 current regimes in the direction of expanding the scope, reviewing favorable conditions for beneficiaries; supplement the support regime for employers who employ a lot of employees who are disabled people, ethnic minorities, the elderly, and support in case of unexpected natural disasters, epidemics, market "shocks", etc.

Amending and supplementing unemployment insurance policies in the direction of supporting businesses and employees to maintain jobs

In addition, to stipulate issues related to the unemployment insurance fund, and the unemployment insurance fund management council (in line with the orientation of the amended Law on Social Insurance); to prescribe the organization and implementation of unemployment insurance policies in the direction of facilitating and promoting reform of administrative procedures.

Synchronous implementation of solutions

The Ministry of Labor, War Invalids and Social Affairs proposes to amend and supplement regulations on compulsory unemployment insurance for employees, including employees who have entered into definite and undefined employment contract terms or labor contract with a definite term of 01 month or more.

Supplement some regulations on participation in unemployment insurance: Responsibilities for notification of employers, handling in case the employer is unable to fully perform unemployment insurance obligations, managing subjects, etc.

Propose to amend regulations on salary as a basis for unemployment insurance payment, including salary and allowances; amending regulations on the ceiling of unemployment insurance premiums in line with the guidelines in Resolution No. 27-NQ/TW and orientations for amending and supplementing the Law on Social Insurance.

Regarding amendments and supplementation of regulations on unemployment benefits: Amend and supplement conditions for enjoying unemployment benefits in the direction of stipulating some additional cases of not being entitled to unemployment benefits such as the employee terminates the working contract/labor contract, or the employee is disciplined and forced to quit, people who are enjoying the monthly pension or monthly allowance for loss of working capacity.

Amend regulations on the maximum unemployment allowance for employees subject to the salary regime prescribed by the state to ensure compliance with the policy of abolishing the base salary according to Resolution No. 27- NQ/TW.

Amend and supplement regulations that employees are not entitled to unemployment benefits and are not allowed to reserve the period of unemployment insurance payment for the period of suspension of unemployment benefits.

Improving vocational skills to maintain jobs for workers

In addition, amend conditions to support training, fostering and improving vocational skills to maintain jobs for employees in the direction of removing the content of "facing difficulty due to economic decline", regulating that the employer is supported when facing difficulties in the case of structural, technological or economic changes as prescribed by the labor law or in the case of implementing the commitment to energy transition.

Regarding amendments and supplementation of regulations on job counseling and introduction, it is crucial to amend and supplement regulations that unemployment insurance participants are entitled to free counseling and job placement; supplement regulations on funding for job counseling and introduction, which is determined on the basis of the number of people consulted and introduced for jobs and the price of public services in accordance with the law on prices.

Amending and supplementing regulations on vocational training support

The Ministry of Labor, War Invalids and Social Affairs also proposed amending and supplementing regulations on vocational training support: Modify the name of the "apprenticeship support" mode to "support training, fostering and improving vocational skills"; supplement regulations on the scope of support including training courses, fostering and improving vocational skills; employees are supported with other expenses (travel, living expenses, etc.) during the vocational training period.

Supplement the employer support regime for recruiting and employing disabled people, ethnic minorities and the elderly, including provisions on support conditions, contents and procedures.

Amending and supplementing regulations on the UI Fund

The Ministry of Labor, War Invalids and Social Affairs also proposed to supplement expenditures of the UI Fund, especially expenditures to support management, develop participants, collect information on labor supply and demand, etc. to contribute labor market management.

Amend and supplement regulations on investment principles of the UI Fund, investment portfolio according to the nature of ownership, profitability and strict risk management, suitable to the nature of the fund.

Besides, supplement regulations on the Board of Management of the UI Fund; additional regulations on management costs of unemployment insurance.
