I have been participating in social insurance for nearly 5 years, then I changed my job and stopped payment since mid-October 2019. Until mid-October 2020, I will be eligible to receive social insurance money, and according to the regulations I figured out myself, I must complete some procedures to receive the money within 30 days from the time I am eligible; However, I am currently working in Thailand so due to the epidemic, I cannot return to receive the money on time. I have consulted the procedure for authorizing a relative to receive, but I cannot sign the power of attorney (POA) as prescribed. Please give me instructions on how to receive the social insurance money in this case. Or else, can I postpone the money receiving time until I am able to return to Vietnam? Under the provisions of Clause 3, Article 110 of the Law on Social Insurance: Within 30 days by the time an employee becomes eligible and requests payment of lump-sum social insurance allowance, he/she shall submit a dossier to the social insurance agency.

In case the employee does not claim the lump-sum social insurance allowance after the time expiry of eligibility, he/she shall continue to reserve the working time to add to the later time of payment of social insurance premium (if any) or enjoy the lump-sum social insurance allowance when required.

Therefore, if you are working in Thailand and cannot return to Vietnam after becoming eligible for the lump-sum social insurance allowance, you can undergo procedures to authorize others to receive it or wait until you return to Vietnam to directly prepare and submit the prescribed dossier. Authorization procedures are performed according to the Power of Attorney (Form 13-HSB) issued together with Decision No. 166/QD-BHXH or the Authorization Contract in accordance with the provisions of the Civil Code.
