Adding more compulsory social insurance participants

In the draft amended Law on Social Insurance, the Ministry of Labour, Invalids and Social Affairs proposes to add more participants to compulsory social insurance for a number of groups with conditions and abilities not yet specified in the law.

According to the Ministry of Labour, Invalids and Social Affairs, currently only nearly 33.5% of the labor force of the age group participates in social insurance, which means nearly 32 million people in the labor force (about 66.5%) have not yet participated in social insurance. The goal by 2030 to have about 60% of the workforce of age participate in social insurance in the spirit of Resolution No. 28-NQ/TW would remain a huge challenge, unless there are basic solutions in terms of both policies and organization and implementation of policies.

Assessing the impact of the 2014 Law on Social Insurance, this agency said that compulsory social insurance still leaves out a number of groups of people who have the need and ability but have not been legislated to participate such as owners of individual business households, enterprise managers, executive managers of cooperatives without salary, employees working under flexible regimes.

According to statistics, while the whole country has more than 5.6 million individual business households, 8 times more than the number of enterprises and according to the data of tax authorities, the whole country has more than 1.7 million turns of tax paying households. However, this group is not currently participating in compulsory social insurance, but only a few individual business owners are currently participating in voluntary social insurance.

The whole country also has about 23,000 active cooperatives, attracting nearly 6 million members; of which 1.2 million workers work in the cooperative sector. However, according to the report of the social insurance agency, currently only nearly 7,000 cooperatives registered to participate in compulsory social insurance for about 41,000 employees.

Through a survey in some localities, many business managers and managers of cooperatives without salary have a desire to participate in compulsory social insurance.
To achieve the goal of Resolution No. 28-NQ/TW on coverage of participants and beneficiaries of social insurance, the Ministry of Labor, War Invalids and Social Affairs proposes to amend in the direction of adding more participants to compulsory social insurance.

Specifically, additional participation in compulsory social insurance will be applied for some groups of subjects with conditions and capabilities such as: owners of individual business households; business managers and executive managers of cooperatives without salary; at the same time, to specify the participation in compulsory social insurance for part-time employees.
