Viet Nam Social Security strengthens dissemination of crime, law-violation prevention

Viet Nam Social Security has ordered its units in provinces and cities nationwide to strengthen dissemination of Resolution No. 96/2019/QH14 about the prevention of crime and law violations to every member of staff and officer of the sector.

The move aims to raise awareness of the fight against crime and law violations as well as preventing violations and crime in the fields of social, health and unemployment insurance.

The agency also required the staff and officers of each unit to raise responsibilities in the performance of tasks to prevent law violations that could lead to the liability of compensation for people, who suffered damage due to the staff and officers’ failure of performing tasks.

The staff and officers of each unit were also required to actively prevent and fight against manifestations of corruption, the agency said.

The units were told to implement judgements and decisions on administrative, civil and labour of court as per the regulations.

They also had to monitor and urge employers to seriously fulfill their obligations of paying social, health and unemployment insurance in accordance with current regulations.

The social insurance units were asked to promptly compile a dossier, asking for prosecution following Document No. 239/BHXH-PC if they found any signs of crime of any individual or organisation, prescribed in Resolution No. 05/2019/NQ-HDTP of the Judges' Council (under the Supreme People's Court).

The resolution was designed to instruct the social insurance units to apply the Article No 214 to deal with fraud in social and unemployment insurance, Article No 215 to deal with fraud in health insurance and the Article No 216 to deal with individuals and organisations who failed to pay social, health and unemployment insurance for employees under the Penal Code.

The social insurance units should promptly report their difficulties, if any, for necessary guidance, the agency said.

On the other hand, the social insurance units had to strictly inspect and handle administrative violations related to social insurance in accordance with the Government's Decree No. 28/2020/ND-CP about administrative sanctions of labour, social insurance and sending Vietnamese employees to work abroad under contracts.

The agency assigns the Legal Department and the Inspection Department to write the annual report to submit to the Ministry of Justice, the Ministry of Public Security and the Government Inspectorate./.
