2025 Law on Employment to expand UI coverage and benefits for participants

The National Assembly (NA) has recently passed the 2025 Law on Employment which includes 8 chapters and 55 articles. The Law will take effect on January 1st 2026, marking an important milestone on finalizing legal system on employment and unemployment insurance (UI) to meet the requirement of socio-economic development in the new period.
The 2025 Law on Employment institutionalizes the 2013 Constitution, the Party’s guideline and the State’s policy on enhancing human resource, employment, labor market, and reforming UI policies.

The Law ensures the consistency and synchronization of the legal system, particularly in relation to newly amended and supplemented laws such as the 2019 Labor Code, the 2020 Law on Residence, the 2020 Law on Vietnamese Guest Workers Working Abroad under Contracts and the 2024 Law on Social Insurance. The Law also aligns with international standards, practices, and employment commitment that Viet Nam has joined such as the United Nations' Convention on the Elemination of All Forms of Discrimination against Women, the Convention on the Rights of Persons with Disabilities, the International Labour Organizaion's Conventions, and other international commitments to which Viet Nam is a party.
The Law addresses existing shortcomings and limitations of the 2013 Law on Employment, particularly in the UI field such as several provisions and policies on UI were previously inconsistent with the 2024 Law on Social Insurance; the scope of UI coverage under the 2013 Law on Social Insurance did not cover all individuals involved in labor relations; the UI policy remained focused mainly on benefit settlement rather than preventive measures on unemployment...
In addition, the Law meets the requirements of enhancing the capacity and effectiveness of state management on employment; timely responses and adapts with population aging and the Fourth Industrial Revolution, and addressing issues related to sustainable employment and labor force management.
