According to Decision No. 1301/QD-BHXH issued by the Director-General of Vietnam Social Security regarding the establishment of an inter-agency inspection team for the enforcement of laws related to social and health insurance premiums payment in Ba Ria-Vung Tau Province, the team will conduct inspections on six businesses located within the territory of Vung Tau City, Phu My Town, Phu My 1 Industrial Zone, My Xuan B1 Industrial Zone, Binh Chau District, and Ba Ria City. The inspection period is set to take place from January 1, 2022, to July 31, 2023. For these businesses, the inspection team will verify their compliance with legal regulations concerning social and health insurance premiums payment. Additionally, the team will also examine the case files involving instances where the Social Security Office forwarded cases to the police but were returned due to insufficient evidence or legal grounds for further processing.

During the working session, the head of the inter-agency inspection team, Bui Quang Huy, emphasized that based on the coordination regulations between Vietnam Social Security and the Ministry of Public Security, in this inspection activity, both parties will identify any obstacles in the inspection process, strengthen documentation, and coordinate in handling criminal acts related to evading social insurance and health insurance contributions according to current regulations. On this basis, they will provide advice, proposals, and recommendations to Vietnam Social Security and the Ministry of Public Security regarding mechanisms and policies to help effectively address cases of evading social and health insurance premiums payment, ensuring the timely protection of the legitimate rights and interests of employees.

The head of the inspection team also mentioned that representatives from the Ministry of Public Security are participating in this inter-agency inspection. Therefore, they suggested that the provincial Social Security Office and the provincial’s Public Security engage in further exchanges to clarify any issues related to the cases of businesses evading social insurance contributions within the region, which have faced difficulties or have been returned in the past. This exchange will enable assessments and analyses to uncover any existing problems or shortcomings, allowing for timely solutions to be developed and implemented.

Major Nguyễn Văn Thời, Deputy Director of Ba Ria-Vung Tau’s Public Security, delivered a speech

Currently, Ba Ria-Vung Tau Social Security Office is managing 7,050 entities, including businesses with 214,500 employees participating in social and health insurance programs. While there are businesses that diligently adhere to the social  and health insurance policies, there are also many businesses that have not fully complied with these regulations. It's worth noting that numerous measures to boost revenue collection, as well as inspection and examination activities, have been actively implemented by the entire Ba Ria-Vung Tau Social Security system.

In recent times, Ba Ria-Vung Tau Social Security Office has consolidated and transferred 24 cases to the Provincial’s Public Security for criminal proceedings against businesses showing signs of evading social and health insurance contributions. In addition to this, representatives from the provincial Social Security Office also highlighted the challenges and obstacles that have arisen during the process of addressing issues related to late or evaded payments of social and health insurance within the region. As a result, they put forward recommendations and suggestions for potential solutions to the inspection team.

Regarding the difficulties and challenges arising in the process of handling cases of evading social and health insurance contributions, representatives from Department PC03 and the leadership of the Ba Ria-Vung Tau’s Public Security have analyzed and clarified certain key points of concern. Additionally, representatives from Vietnam Social Security and the Ministry of Public Security have engaged in exchanges and provided guidance on various solutions to address these issues and facilitate their resolution.

During the working session, Major General Nguyen Van Thoi, Deputy Director of Ba Ria-Vung Tau’s Public Security, stated that the provincial police consistently prioritize the implementation of social and health insurance policies within the region, particularly when it comes to addressing cases of evading social and health insurance contributions. Therefore, ensuring social security for employees through compliance with social and health insurance contributions is closely linked to maintaining stable labor relations and public order within the territory.

According to Major General Thoi, after the cooperation regulations were signed by Ba Ria-Vung Tau Social Security Office and the provincial’s Public Security, the various units under the provincial’s Public Security have consistently collaborated closely with the provincial Social Security office, leading to significant results. For example, since the beginning of the year, the Ba Ria-Vung Tau’s Public Security have initiated four cases related to social and health insurance policy violations. Additionally, the coordination and exchange of tasks related to the implementation of social and health insurance policies for employees have been conducted in close collaboration between the provincial police leadership and local police agencies, along with the Social Security Office and have proven effective.

During the working session, Mr. Pham Ngoc Son, the Director of Ba Ria-Vung Tau Social Security Office, mentioned that since the signing of the Cooperation Regulations No. 101/QCPH-CA-BHXH between the provincial Social Security Office and the provincial’s Public Security, the efforts in preventing and combating social and health insurance crimes have been actively pursued, especially in data sharing and joint actions. For instance, recently, the provincial Social Security Office forwarded case files involving counterfeit certificates of retirement benefits to the provincial police, who promptly accepted and handled them. To maximize the effectiveness of this cooperation, Mr. Son requested that Social Security offices at the local level be proactive and enhance their collaboration with the local public security in handling businesses with arrears or those evading social and health insurance premiums payment.

In conclusion, the head of the inter-agency inspection team, Bui Quang Huy, suggested that Ba Ria-Vung Tau Social Security Office should strengthen measures to thoroughly review companies in violation, particularly those showing signs of evading social  and health insurance premiums payment. This not only ensures better protection of employees' rights but also provides a basis for the inspection team to advise the leadership of both sectors in addressing arrears and evasion of social insurance and health insurance contributions more effectively.

Vietnam Social Security has implemented several measures to minimize instances of businesses and entities being late in paying social and health insurance contributions in recent times

In the afternoon of the same day, the inter-agency inspection team from Vietnam Social Security and the Ministry of Public Security began their working program with businesses. These sessions involved the participation of representatives from Ba Ria-Vung Tau Social Security Office and the provincial Public Security.

In recent times, Vietnam Social Security has actively cooperated with various ministries, committees, and relevant agencies to implement numerous measures aimed at minimizing cases of businesses and entities being late in paying social and health insurance contributions, as well as enhancing revenue collection and debt reduction efforts. These measures include strengthening inspections, conducting surprise checks, and promptly addressing violations. Additionally, efforts have been made to improve the management of social and health insurance benefits payments, preventing any misuse of these funds to ensure the maximum protection of the rights and benefits of the people and businesses.
