Timely implementation of the Coordination Regulation

Reporting to the delegation, Nguyen Thanh Danh - Director of Quang Nam Social Security Office said, on September 29, 2022, the Quang Nam Provincial Police and Social Security Office held a conference to review and evaluate the implementation results of the Regulation on coordination No. 03/QCPH-CA-BHXH between the Quang Nam Provincial Police and the Social Security Office in the prevention of crimes and violations of the law on social and health insurance. Moreover, he also signed a plan to coordinate the implementation of Coordination Regulation No. 01/QCPH-BCA-BHXHVN dated January 21, 2022, of the Ministry of Public Security and the VSS, in order to ensure the unified direction between the two branches in coordination.

Accordingly, in the past time, the Provincial Police regularly provided information and situation on the plots, methods, and tricks of anti-destructive activities of hostile and reactionary forces; the situation of internal political security, economic security, network security; loopholes and shortcomings in the implementation of social and health insurance regimes and policies that subjects take advantage of to commit illegal acts. Thereby, the social security agency would be aware to proactively prevent, detect and prevent.

The provincial social security agency also regularly exchanges and provides information to the provincial police on the situation related to internal party organizations, units, and mass organizations; the observance of the law by officials and party members; situation and results of professional work to serve the protection of internal political security and economic security.

According to Colonel Nguyen Thanh Long - Deputy Director of Quang Nam Provincial Police, the Provincial Police have directed the Criminal Investigation Department on corruption, economy and smuggling (PC03) and the Criminal Investigation Team on economic management and function under the Police of districts, towns, and cities to support professional departments of provincial and district-level social security offices in inspecting and examining employers' units, in order to help recover outstanding debts and develop participants of social, health insurance.

Coordination to solve "hot" issues

In spite of the close coordination between the two units, Nguyen Thanh Danh emphasized that coordination activities are facing a great number of difficulties, especially in handling violations of units and enterprises. For example, some enterprises take advantage of the loopholes in the mechanism and policies of social insurance; the sanctions for handling violations are not strict, and the level of penalties for late payment and evasion of social insurance contributions is low. Notably, some businesses deliberately delayed payment and owed social and health insurance premiums for a long time. Some enterprises were dissolved, went bankrupt, and their owners fled, leading to many employees not being able to close their social insurance books and not having their benefits resolved.

Besides, the awareness of some employers towards their employees is not high; the situation of avoidance or insufficient payment for the number of employees who are working still occurs in some localities, which affects the interests of employees.

Sharing more about the above situation, a representative of PC03 (Quang Nam Provincial Police) said that in the past time, the two units have regularly exchanged information about social insurance debts and profiteering from the health insurance regime. Thereby, arrears of social and health insurance were collected at 58 enterprises with an amount of over 9 billion VND. However, according to the representative of PC03, the situation of violations continues, since it is difficult to prove the fraudulent elements in the debt of social and health insurance.

At the inspection, Nguyen Qui Quy - Deputy Director of Quang Nam Department of Labour, Invalids and Social Affairs emphasized that the implementation of the Regulation on coordination between the Quang Nam Provincial Police and Social Security Office is a great solution to developing participants of social and health insurance. Quy also said that, although the violations of social and health insurance in Quang Nam province are not too complicated, the amount of social insurance debt is quite high (213 businesses with a debt of more than 230 billion VND), while the level of penalty is too low. Therefore, Quy suggested that the delay in payment of social and health insurance should be considered a serious violation.

Meanwhile, Do Ngoc Tho - Director of the Department of Social Insurance Implementation (VSS) expressed concern about increasingly sophisticated violations of the law on social and health insurance such as buying and selling social insurance books, issuing false sick leave certificates for social insurance benefits, borrowing records to go to work, forging papers to appropriate social insurance, etc.

According to Tho, there are clinics that issue sick leave certificates with the proposed amount of up to billions of dong, which not only affects the social insurance fund but also affects the production and business plans of enterprises. Or as in Quang Nam province, there was a case of using one phone number to receive one-time social insurance allowances twice.

Concluding the inspection, Major General Nguyen Bach Dang said that in the past time, violations of the law on social and health insurance have become more complicated, but sanctions are not enough deterrent; many cases even ask for a fine to continue the violation next time.

Faced with the above situation, Major General Nguyen Bach Dang asked the two units to pay attention to well implementing information and propaganda work, focusing on information on the implementation of regimes and policies for employees and debtors for 3 months or more, in order to have a solution to recover debts and ensure the interests of employees. In addition, Major General Nguyen Bach Dang also asked the two units to step up propaganda to all officers, soldiers, and civil servants of the unit about the meaning and importance of coordination work.
