Detailed Regulation on laborers' unemployment insurance participation

As an important policy of the social security system, unemployment insurance (UI) supports finance for employees in case they lose their job. Approved by the 15th National Assembly of Vietnam on Jun 16th 2025, effective from Jan 1st 2026, the article 31 of Law on Employment No. 74/2025/QH15 specifically regulates compulsory UI participants. Therefore, it is easy to define both employee and employer’s responsibility.

Compulsory unemployment insurance employees

Under Law on Employment No.74/2025/QH15’s clause 1, article 31, compulsory social insurance participants include: 

Employees with labor contracts include an indefinite and definite term labor contract from a full 1 month. The regulation is applied with contract under another title as long as the content describes paid employment under management, administration, and supervision by one party.

Social insurance shall also cover part-time employees with a monthly salary equal to or higher than the base salary on compulsory social insurance premiums payment under regulation.

Paid Manager and management positions include enterprise manager, controller, capital representative, Board of Management member, General Director, Director, Board of Supervisor member or other management titles voted by cooperative, union of cooperatives.

If the employee is included in various UI participation objects under Clause 1, both the employee and employer are responsible for participating in compulsory social insurance.

Ineligible UI participation cases

 Employers participating in UI include: state agencies, non-business units; agencies, enterprises of the People's Army, People Public Security and Government Cipher organizations; policy, policy-society, society-profession; socio-professional organizations; other society organizations; international agencies and organizations in Vietnam; enterprises, cooperative group, Vietnam Cooperative Alliance, business households, other organizations, employers under clause 1 of this article.  

Clause 2 details ineligible UI participation cases: employees enjoying a pension, social insurance benefit or monthly benefit under the government’s regulations, being entitled to pension enjoyment; employees working under labor or probationary contract; housekeepers.

Clause 4 of Article 31 brings the possibility of increasing UI participants.  The Standing Committee of the National Assembly may approve UI participation for other employed people with stable incomes under the Government’s proposal suitable for socio-economic conditions development.
