Regulations updated for voluntary social insurance under The Social Insurance Law

The Government has issued Decree 159/2025/ND-CP detailing and guiding the implementation of several provisions of the Law on Social Insurance regarding voluntary social insurance, as follows:

(1) Clause 7 of Article 23 about the regime for participants in voluntary social insurance who do not meet the conditions for pension and do not meet the age requirement to receive social pension allowances.

(2) Clauses 1 and 4 of Article 36 regarding the contribution amount, payment methods, and deadlines for participants’ contribution in voluntary social insurance; changing the payment method and monthly income used as the basis for voluntary social insurance contribution; refunding the previous contribution for voluntary social insurance.

(3) Clause 6 of Article 102 regarding receiving the lump-sum social insurance entitlement.

(4) Clause 2 of Article 104 regarding the adjustments of monthly income that has contributed used as the basis for contributions to social insurance.

(5) Clause 2 of Article 111 regarding the retirement and the survivorship benefits  for individuals who have both mandatory social insurance contribution period and voluntary social insurance contribution period.

(6) Clause 15 of Article 141 regarding transitional provisions.

Decree No. 159/2025/ND-CP took effect on July 1, 2025. Decree No. 134/2015/ND-CP dated December 29, 2015, of the Government which detailed several provisions of the Social Insurance Law regarding voluntary social insurance, ceased to be effective from that date./.
