Workers proposed to handle social insurance debt bussinesses

Workers in Tien Giang province request that this revision of the Social Insurance Law must overcome and strictly handle business owners who intentionally avoid paying social insurance to ensure the rights of workers (employees).

On May 7th, the Labor Confederation of Tien Giang province organized a specialized voter contact conference between National Assembly deputies, leaders of Tien Giang province and workers.

At the conference, voters of workers and trade union officials expressed their opinions on the issues such as: Black credit, contributions to the draft Law on Social Insurance, comments on the draft Law on Trade Union, and handling businesses which have been avoiding, delaying, and owing social insurance to workers...

Le Thi Bich Tuyen - a worker who is working at Long Giang Industrial Park (Tan Phuoc district, Tien Giang province) said that currently, businesses in the province are evading, delaying payment, and appropriating social insurance premiums of workers is still happening, greatly affecting the rights of workers.

Tuyen proposed that this law amendment must overcome the above situation and strictly handle business owners who intentionally avoid paying social insurance to ensure the rights of workers in participating in social insurance.

Responding to voters' opinions, Nguyen Thi Nhu - Deputy Head of Collection Management Department - Books and Cards (Social Insurance of Tien Giang province) said that currently, the handling of businesses that evade, delay, and pay debt social insurance for workers is facing difficulties.

Lacking of document which state clearly what is evasion of social insurance payment, there is no basis to determine errors to punish administrative violations of evasion as a premise for criminal handling.

In addition, the act of late payment of social insurance is not enough to constitute the crime of evading social insurance payment. Therefore, businesses that are slow to pay large amounts of money for a long time have not yet been criminally prosecuted. At the same time, there are no regulations on handling administrative violations against managers, executives, or legal representatives of the employing unit.

According to Nhu, this content has been added to the recently revised draft of the Social Insurance Law for submitting to the National Assembly for consideration to clearly stipulate and handle the above acts.
