Regulations on national database list; building, updating, maintaining, exploiting and using the national database

The Government has just issued Decree No. 47/2024/ND-CP dated May 9th, 2024 on providing regulations on the List of national database; building, updating, maintaining, exploiting and using the national database.

Accordingly, the National Database is built, exploited and used uniformly from central to local levels. The national database information system is managed, built and maintained centrally. The government is the data owner and unifies data management. The Government assigns the National Database Managers to manage, exploit and use under their functions and tasks. At the Appendix issued together with the Decree, the National Database List includes 10 databases: National population database, national land database, national database on business registration, national database on finance, national database on insurance, national database on cadres, civil servants and public employees in state agencies, national database on administrative procedures, national overall database, national database on construction activities, national database on immigration.
The national database on insurance, managed by VSS, was built with the goal of storing information on social insurance, health, unemployment and information on health and social security authorized by relevant agencies and ensuring citizens’ insurance rights and obligations and sharing data with ministries, branches and localities nation-wide. Scope of data, information about stored and shared master data, objects and purposes of exploitation, use and information sources to be built and updated by the National Insurance Database are implemented under the regulations of the Decree No. 43/2021/ND-CP dated March 31st, 2021 of the Government providing regulations on the National Database on Insurance. The method of sharing data from the national database shall be implemented under regulations of the Decree No. 47/2020/ND-CP dated April 9th, 2020 of the Government on digital data management, connection and sharing by State agencies and relevant legal regulations; in consistent with Vietnam e-Government Architecture Framework. This Decree shall take effect from the date of signing and the regulations on building, updating, maintaining, exploiting and using the national database which are not consistent with the regulations as stipulated at this Decree shall apply the regulations as stipulated at this Decree.

PM Chinh stressed that a shared national database should be completed in 2023. He pointed out a number of shortcomings in the work, including an incomplete digital infrastructure and a big gap between urban and rural areas. He noted that Vietnam still has 266 hamlets and villages that have yet to access power and Internet services, asking relevant agencies to work together to ensure that these services are provided to all hamlets and villages within 2023, thus creating an equal development chance for all people and not leaving anyone behind.
According to Clause 4, Article 3 of the Law on Citizen Idenfitication 2014, national population database means a collection of basic information about all Vietnamese citizens, which is standardized, digitalized, stored and managed in an information infrastructure to serve state management work and transactions among agencies, organizations and individuals.
Pursuant to Clause 1, Article 4 of Circular 46/2022/TT-BCA, databases that share information about citizens with the National Population Database system according to the provisions of the law include:
- Shared electronic civil status database;
- Residence database;
- Citizen Identification Database;
- Medical database;
- Other specialized databases.
Specialized information associated with citizens (specified in Appendix I issued with Circular 46/2022/TT-BCA) when shared by agencies and organizations with the Ministry of Public Security:
The National Population Database Management Agency of the Ministry of Public Security is the receiving focal point to exploit and use for population management and meet other professional work requirements of Police units and localities according to assigned functions, tasks, and powers.
Citizens may look up and exploit information through the public service portal according to the provisions of Article 12 of Circular 46/2022/TT-BCA, as follows:
- Citizens log in to the public service portal.
- Citizens choose a lookup service or a personal information exploitation service.
- The Ministry of Public Security returns citizens' search results using information displayed on the public service portal or returns information exploitation results using Notice according to Form No. 01 issued with Circular 46/2022/TT-BCA
United State's National Database
Various national database of United States persons, and their activities, have been compiled by government and private entities. Different data types are collected by different entities for different purposes, nominal or otherwise. These databases are some of the largest of their kind, and even the largest ever. Accessibility of government databases may be controlled by various means, such as requirement of a warrant, subpoena, or simple request from another branch of government. Commercial databases are generally established for profit. Some other databases are available for free usage with various states across the United States. Typical instances include Colorado Resident Directory and many others out there on the internet. Data breaches may occur as a result of a vulnerability or publication in error.
