To amend and supplement a number of regulations on social and unemployment insurance

Recently, the Prime Minister issued Decision No. 889/QD-TTg on promulgating the list of legal documents that need to be amended, supplemented and promulgated. Accordingly, there will be 16 Laws that need to be amended, supplemented and promulgated; 12 Decrees issued by the Government and 04 Circulars issued by Ministers and Heads of ministerial-level agencies.

Specifically, according to Decision No. 889/QD-TTg, the Laws that need to be amended, supplemented and promulgated include the Law on Insurance Business in 2000 (amended and supplemented in 2010, 2019); Price Law 2012; Electricity Law 2004; Law on Social Insurance 2014; Land Law 2013; Housing Law 2014; Law on Employment 2013; The 2015 Law on Occupational Safety and Hygiene, etc.

Regarding social and unemployment insurance, in the Employment Law 2013, it is expected to amend and supplement regulations to handle the following issues in accordance with practice as recommended in Section II.5.2.2, Part B Report No. 442/BC-CP on subjects participating in unemployment insurance; conditions to support training and retraining to improve vocational skills; inadequacies in the unemployment insurance policy arising during the time the Law comes into force after its promulgation (the time to submit the application dossier to the Government in February 2022).

In the 2015 Law on Occupational Safety and Health, it is expected to be amended and supplemented to deal with regulations restricting subjects from participating in occupational safety training services and technical inspection service (according to the recommendations in Section II.5.2.1, Part B of Report No. 442/BC-CP) on the development of the project to summarize and evaluate the implementation to consider and propose the formulation of the Law on Occupational Safety and Health (amended) in 2021 (the time to submit to the Government the application for the development of the Law in the period of 2021-2025).

In the 2014 Law on Social Insurance, it is expected to amend and supplement according to the reform orientation in Section III of Resolution No. 28-NQ/TW dated May 23, 2018 of the 7th Plenary Session of the 12th Central Committee on Social insurance policy Reform as recommended in Section II.5.2.3, Part B Report No. 442/BC-CP (according to the Work Program of the Government, Prime Minister in 2021): Gradually reduce the minimum number of years of payment of social insurance to pension, applying appropriate regulations to reduce the status of lump-sum social insurance allowance in the direction of increasing benefits if the time to participate in social insurance is reserved to enjoy the retirement regime, reducing benefits if enjoying lump-sum social insurance allowance, amending regulations on the basis for payment of social insurance contributions of the enterprise sector at least equal to about 70% of the total salary and other incomes of the salary nature of employees (expected time to submit the application dossier to the Government is June 2021).

Based on the List, ministers and heads of ministerial-level agencies in charge of drafting legal documents shall have the responsibility to closely coordinate with agencies of the National Assembly to urgently study and propose solutions to deal with the problem. Draft legal documents to be submitted to the National Assembly and the Standing Committee of the National Assembly for consideration and approval or for comments on law/ordinance projects already included in the 2021 law/ordinance formulation program. To closely coordinate with the Ministry of Justice to urgently study and propose to include in the program of law and ordinance development in 2022 and the following years legal documents issued by the National Assembly and the Standing Committee of the National Assembly promulgated by the association has not yet been included in the law/ordinance formulation program in accordance with the Law on Promulgation of Legal Documents. To focus on directing and speeding up the drafting progress and submitting to the Government and the Prime Minister for promulgation legal documents already in the Work Program of the Government and the Prime Minister in 2021; to closely coordinate with the Government Office to study and propose to be included in the Work Program of the Government and the Prime Minister in 2022 and the following years. To expeditiously handle legal documents promulgated by ministers and heads of ministerial-level agencies. At the same time, to continue to review, summarize and evaluate the overall situation of the implementation of legal documents along with the issues mentioned in the List in the process of drafting and promulgating legal documents.
