Vietnam Social Security: Resoluteness in preventing acts of collecting, buying and selling social insurance books for self-seeking purposes

On April 13, Vietnam Social Security issued Official Letter No. 1164/BHXH-CSXH to Social Security of provinces and cities directly under the Central Government and Official Dispatch No. 1165/BHXH-ST to the Ministry of Labor, War Invalids and Social Affairs, which clearly expressed viewpoints and guidelines of the social insurance industry in resolute prevention of collecting, buying and selling social insurance books for self-seeking purposes.

Social security of localities: Timely involvement is required

Recently on the social network, false information and acts of impersonation have been recorded in order to purchase social insurance books of workers, taking advantage of COVID-19 epidemic making it difficult for workers' lives. A specific case was recorded in Binh Duong province. Implementing the direction of Deputy Prime Minister Truong Hoa Binh in Official Letter No. 2858/VPCP-NC dated April 12, 2020 on the press informing about acts of collecting, buying and selling social insurance books for self-seeking purposes, on April 13, Vietnam Social Security issued Official Letter No. 1164/BHXH-CSXH requesting social security agencies of provinces and cities to implement the following contents:

1. Urgently review and grasp the situation of collecting, selling and buying social insurance books in their management localities according to the press' feedback.

2. Strictly comply with the provisions of the law on social insurance, the professional processes and directions of Vietnam Social Security in Official Letter No. 4733/BHXH-CSXH dated December 18, 2019 focusing on the following contents:

- When receiving employees’ applications for one-off social insurance claim: Information must be controlled in the Application (Form No. 14-HSB); Collate the data on the System with the information in the social insurance book and the Application, ensuring that the beneficiary's information is consistent; Check the legality of the Power of Attorney (POA) or Authorization Contract.

- During settlement process, it is required to check and collate, ensuring qualification for one-off social insurance claim under Article 60 of the Law on Social Insurance and Article 1 of Resolution No. 93/2015/QH13 dated June 22, 2015 of the National Assembly and Article 4 in Circular No. 56/2017/TT-BYT dated December 29, 2017 of the Ministry of Health.

- Once the settlement results of one-off social insurance claim are released, it is required to carefully check and collate the ID papers of the person who receives the results; make sure the files and the claim can only be given to the employees or the legally authorized person.

- Carry out verification and inventory of cases where one person is authorized to receive social insurance once for two people or more; detect signs of profiteering from collecting, selling and buying social insurance books.

3. Actively coordinate with local agencies, departments and sectors to enhance the propagation and dissemination of legal policies on social insurance to raise employees' awareness of entitlements to social security policies from the Party and State; at the same time, give warnings to people and employees not to be instigated or dragged into selling social insurance books and promptly detect and denounce violations.

4. Report to the provincial/municipal People's Committee to direct the competent local agencies to coordinate with the provincial social security agencies in taking measures to promptly prevent collecting, buying and selling social insurance books for self-seeking purposes; investigate and strictly handle typical violations.

Vietnam Social Security requires Directors of provincial and municipal agencies to seriously abide by the guidance of the Deputy Prime Minister.
