Labour ministry issues 18 social insurance admin procedures

The Ministry of Labour, Invalids and Social Affairs (MOLISA) has issued a new administrative procedure and made amendments to 17 other procedures related to social insurance.
The new procedure defines lump-sum allowances for people who are entitled to pension, monthly social insurance benefits but no longer reside in Vietnam.
Accordingly, people who are receiving a pension or monthly social insurance benefits but no longer reside in Vietnam will receive lump-sum allowance.
These people, if wishing to receive their allowance, must submit a written request to the social insurance agency.
Within five working days of receiving the request, the social insurance agency must be held responsible for dealing with the case; if the case cannot be handled, the agency must issue a written reply stating the reason.
The written request and other required documents can be submitted directly to the social insurance agency, online or via postal service.
The procedure follows regulations stated in the Government’s Decree 143/2018/ND-CP dated October 15, 2018. It details the Law on Social Insurance and the Law on Occupational Safety and Health regarding compulsory social insurance for employees being foreign citizens working in Viet Nam.
Other amended and added procedures include first-time registration of compulsory social insurance; re-issuance of social insurance books; and adjustments to information of employees on social insurance.
The amended procedures also instruct employees on steps to enjoy allowance while on sickness leave, maternity leave (for both female employees and husbands), and retirement for those who are on compulsory and voluntary social insurance.
Other procedures are about survivor benefits upon death due to occupational accidents or occupational diseases.
The documents issued by MOLISA also regulate processes to implement the procedures and assign social security agencies to take on the tasks./.
