Developing the labor market, ensuring sustainable employment, expanding the number of participants in unemployment insurance

In the afternoon of November 3rd, at the National Assembly’ Headquarter, the NA Standing Committee provided its opinions on the draft Law on Employment (amended). Vice Chairman of the NA Nguyen Khac Dinh chaired the meeting.

Presenting the Report on the draft Law on Employment, Minister of Labor - Invalids and Social Affairs (MOLISA) Dao Ngoc Dung said that the purpose of building the law is to institutionalize the Party's policies and guidelines; ensure the synchronization, unity, and consistency of the legal system under the management and regulation of the State; meet the needs of socio-economic development; be consistent with the international commitments that Vietnam participates in, contribute to promoting the development of the labor market, towards ensuring sustainable employment for all workers.

The Draft Law on Employment (amended) has institutionalized the goal of creating sustainable, quality employment, supporting human resource development and labor market development as regulated at the Documents of the 13th National Congress of the Party, Resolution No. 42-NQ/TW; the reform contents on unemployment insurance policy of Resolution No. 28-NQ/TW; Closely following the 4 groups of policies in the proposal to develop the Law project approved by the NA at Resolution No. 89/2023/QH15; Synthesizing recommendations of NA Deputies and voters on the field of employment; Reviewing limitations, difficulties and inadequacies arising in the summary of the implementation of the Law on Employment in 2013, assessing the current status of related social relations; Reviewing international treaties and commitments related to the field of employment.

In addition, the draft law also adds provisions to support job creation for the elderly; employment support policies in the context of crisis, economic recession, natural disasters, and epidemics. Supplementing regulations on electronic transactions in the employment sector: regulations on employment service business activities in the form of e-commerce; regulations on building a national online job exchange to develop employment services. Amending regulations on the system of public employment service centers in the direction of streamlining and professionalizing. Reviewing, amending, and supplementing the conditions for receiving unemployment benefits to limit fraud and profiteering from unemployment insurance, ensuring compliance with the policy under Resolution No. 27-NQ/TW on reforming wage policies and the Law on Social Insurance 2024.

Reviewing this content, Chairwoman of the NA Social Committee Nguyen Thuy Anh said that the Social Committee basically agrees with the necessity of amending the Law and the viewpoints on building the Law. However, how to make the amendment of the Law to create a solid legal corridor for the construction and synchronous development of labor market factors, contributing to the positive shift in labor structure, the amendment of the Law must inherit and develop current regulations, only stipulate at the Law the contents that have been tested in reality, amend inappropriate regulations, overcome difficulties and obstacles caused by the provisions of the current Law on Employment, ensure feasibility, synchronization and unity of the legal system.

The Chairman of the Social Committee proposed to continue to clarify issues arising in the ptocess of implementation, research to make regulations in consistent with the development of labor relations and labor markets in our country; research, supplement and perfect regulations, clarify policies to support the development of specific labor markets, especially the development of labor markets in rural areas, laborers of ethnic minorities, female laborers, the elderly, and high-skilled labor markets. Ensure budget for policies and regimes funded by the state budget; the ability to balance the Unemployment Insurance Fund.

In addition, it is necessary to study and develop mechanisms and promote the application of information technology in building databases, connecting information, forecasting, and orienting the development of the labor market in accordance with the socialist-oriented market economy.

Study and supplement policies to encourage and support the development of sustainable employment and high-value employment in line with the new development stage of the country. Promote the role and responsibility of the Vietnam Public Sector Union, socio-political organizations, and professional associations in developing and managing members; connecting, sharing, and exchanging information between workers working in the same field and connecting information with state management agencies, agencies implementing policies and laws on employment to improve the effectiveness of rights protection, support and promote job search connections, career transitions, and improvement of professional skills... for workers who are its members and other workers in general.

Providing opinions at the session, NA Chairman Tran Thanh Man stated that the submission of the revised Law on Employment at the 8th Session has received special attention from voters and the people. The NA Chairman requested the Finance - Budget Committee and the Economic Committee to continue studying and providing further comments on the contents related to the regulations on the use of state budget and the use of loans to create jobs. The Government needs to continue studying and amending the regulations on loan sources for creating jobs as stipulated at the Article 7, including transferring the national employment fund to the central budget source allocated to the Social Policy Bank; ensuring lending resources for local budget sources entrusted to the Social Policy Bank at the localities.

It is necessary to study and supplement specific and appropriate regulations to ensure the feasibility of regulations on policies to support job transition for workers in rural areas, public employment policies, and employment support policies for the young people and the elderly.

At the same time, the NA Chairman suggested that it is necessary to have solutions to expand the number of participants in unemployment insurance; ensure the feasibility of regulations on labor registration; study and supplement expanded support policies for private employment service organizations, the feasibility of regulations on employment service consultants, and the responsibility of the Minister of Labor, War Invalids and Social Affairs in promulgating the National Standards on employment services.

Concluding the discussion, Vice Chairman of the NA Nguyen Khac Dinh stated that this draft Law has seriously absorbed the opinions of the NA Standing Committee and the opinions of the reviewers; The drafting agency has demonstrated a sense of responsibility and promptly completed the dossier to submit to the NA Standing Committee with an innovative mindset in law-making. The NA Standing Committee highly appreciated the Social Committee for promptly coordinating with the drafting agency and organizing a plenary session to review the draft Law.

The NA Standing Committee unanimously assessed that the dossier of the revised Law on Employment is eligible to be submitted to the National Assembly for consideration and providing comments at the 8th Session, and approved at the 9th Session. The Social Committee needs to promptly complete the review report on the draft Law to submit to the NA under regulations. The Vice Chairman of the National Assembly requested the Government and the drafting agency to continue to study and absorb the basis of the opinions of the National Assembly Chairman, the opinions of the Social Committee, and the agencies participating in the review, and complete the dossier to send to the National Assembly deputies to serve the in-group and in-hall discussion session and at the 8th Session.
