How is the administrative procedure ‘Settling pension benefits for individuals participating in voluntary social insurance, preserving the contribution period’ implemented?

Based on point 8.2, clause 8, Section III of the Appendix accompanying Decision No. 896/QD-BHXH of the General Director of Vietnam Social Security, the procedure for implementing this administrative procedure is as follows:

1. Document submission: Participants in voluntary social insurance, individuals preserving the contribution period (including those serving a prison sentence, individuals illegally emigrating and returning to the country for legal settlement, individuals whose missing declaration decision has been canceled by the court) submit documents through one of the following methods:

a. Via electronic transactions: Individuals register to receive an authentication code and submit electronic documents to the Vietnam Social Insurance’s Public Service Portal or through the I-VAN organization (if registered to use the I-VAN service). If not converting paper documents to electronic format, submit paper documents to the social insurance agency via postal services.

b. Via postal services.

c. Directly at the social insurance agency.

2. Receive results: Employees receive:

• Relevant paper documents in the registered form (directly at the social security agency or via postal services or through electronic transactions).

• Receive pension, benefits in one of the following forms:

+ Through personal bank account.

+ Via postal services.

If authorizing someone else to receive, follow the regulations in the E-services “Authorization to receive unemployment benefits” or the original copy of the Authorization Contract as regulated by the law.

I lost my Health Insurance Card. What should I do to retrieve the Health Insurance card number?

In case you have lost your Health Insurance card and cannot remember the card number, you can retrieve the information through various means: check the list of issued Health Insurance cards stored at the unit, call the Customer Support Center of VSS via the hotline 19009068, look up the card number on the VSS electronic information portal (at http://www.baohiemxahoi.gov.vn), with the condition of having sufficient information including: full name; date of birth; address of household registration (commune, district, province); and identity card number. Additionally, you can contact the local social security agency that issued the card to proceed with the issuance of a new Health Insurance card or contact post offices, cultural post offices, commune People’s Committees, units, agents participating in social insurance, health insurance to get assistance in finding the Health Insurance card number and addressing any other issues (if any).

How are the time limit and results regulated for ‘Adjusting, canceling decisions, terminating social insurance benefits’?

Based on point 7.1, clause 7, Section III of the Appendix accompanying Decision No. 896/QD-BHXH of the Director-General of Vietnam Social Security:

  • The time limits for ‘Adjusting, canceling decisions, terminating social insurance benefits’ are as follows:
  1. For occupational accident and disease insurance, social insurance for officials and employees: a maximum of 06 working days from the date the social security agency receives complete documents as prescribed.
  2. For monthly pension and social insurance benefits: a maximum of 12 working days from the date the social security agency receives complete documents as prescribed.
  3. For one-time social insurance and benefits for individuals currently receiving monthly benefits and settling abroad: a maximum of 05 working days from the date the social security agency receives complete documents as prescribed.
  4. For funeral benefits: a maximum of 08 working days from the date the social security agency receives complete documents as prescribed.
  • Results of ‘Adjusting, canceling decisions, terminating social insurance benefits’ are demonstrated through:

+ Decision on adjusting, canceling, or terminating benefits (Forms: 6A-HSB, 6B-HSB, 6C-HSB).

Back pay or recollection of overpaid amounts (if any).

How are the time limit and results regulated for 'Settling occupational accident and disease, social insurance benefits for employees previously granted such benefits and now continue to suffer occupational accidents or diseases'?

Based on point 6.1, clause 6, Section III of the Appendix accompanying Decision No. 896/QD-BHXH of the Director-General of Vietnam Social Security:

  • The time limit for 'Settling occupational accident and disease, social insurance benefits for employees previously granted such benefits and now continue to suffer occupational accidents or diseases' is a maximum of 06 working days from the date the social security agency receives complete documents as prescribed.
  • Results of settling this administrative procedure are demonstrated through:

+ Decision on monthly occupational accident or disease benefits (Forms: 03M-HSB, 03N-HSB) and Decision on providing funds for medical treatment, rehabilitation equipment (Form: 03P-HSB) (if any).

+ Insurance contribution history (Form: 04-HSB).

+ Health insurance card for cases of resigning while enjoying occupational accident or disease benefits.

+ Benefit payments.

How are the rights of organizations and individuals requesting the implementation of administrative procedures in the electronic environment regulated?

According to Article 5 of Decree 45/2020/ND-CP on implementing administrative procedures in the electronic environment, organizations and individuals with requests for the implementation of administrative procedures in the electronic environment are entitled to:

a. Receive support during the process of implementing administrative procedures in the electronic environment.

b. Look up, monitor, download the entire electronic records of successfully submitted administrative procedures from the National Public Service Portal, provincial-level and district-level Public Service Portals, and electronic results of resolved electronic administrative procedures.

c. Safely store and archive electronic records, documents, results of administrative procedure resolution, as stipulated by the law.

d. Request the competent authority to confirm in writing the implementation of administrative procedures in the electronic environment to serve other related activities within the scope defined by the law. The request and confirmation must comply with the regulations on access to information.

e. Request the competent authority to share information, data as the result of resolving electronic administrative procedures with other agencies to serve the legitimate interests of the organization, individual.

f. Be recognized the results of resolved electronic administrative procedures and the signed electronic records of the competent authority, organization, individual according to the regulations of the law in electronic transactions.

g. Exercise the rights as prescribed in the Law on E-transactions, the Law on Information Technology, and documents guiding the Law, and perform the rights and responsibilities stipulated in Clause 1, Article 6 of Decree No. 61/2018/ND-CP dated April 23, 2018 of the Government on implementing the one-stop-shop mechanism and connected one-stop-shop in resolving administrative procedures.
