VSS instructs on use of support for employees, employers from unemployment insurance fund

Viet Nam Social Security (VSS) has issued and sent Document No 3068/BHXH-CSXH to social insurance agencies in Central provinces and cities, and the social insurance agencies of the Ministry of National Defence and People’s Public Security, guiding the implementation of the Prime Minister’s Decision No 28/2021/QĐ-TTg dated October 1, 2021. Decision No 28 stipulates the implementation of support policies for employees and employers affected by COVID-19, using financial sources from the Unemployment Insurance Fund.

Accordingly, VSS requires affiliated units, and social insurance agencies of provinces and cities to carry out the procedures in a simple, convenient and time-saving manner to make sure that labourers can get the support as soon as possible whilst employers enjoy monthly payment reductions.  

VSS also requires the use of VSS’ available information technology databases to identify the beneficiaries and enterprises in reference to the payment to the UnemploymenInsurance Fund. Furthermore, it is essential to bring into full play the role and responsibility, and to properly perform functions and duties as assigned and decentralised and in line with professional processes of the social insurance system. It is necessary to strengthen administrative discipline, the spirit and attitude to serve people and enterprises of social insurance agencies’ civil servants and public employees.

In Document No 3068/BHXH-CSXH, VSS provides specific guidance on determining beneficiaries, support levels, and support period in accordance with Decision No 28/2021/QĐ-TTg; the decentralisation and implementation process for each section at the social security agencies of the province and cities, namely: Section in charge of receiving dossiers and returning results of administrative procedures; Division/Section in charge of collecting insurance premiums; Book and Card Issuance Division/Section; Division/Section in charge of social insurance regimes; and the Planning – Finance Division/Section.

In the implementation process, VSS assigns the Social Insurance Implementation Department to work with competent units to urge, guide and inspect the implementation. VSS’ affiliated units should be proactive in implementing relevant contents according to their functions and tasks.

For social insurance agencies of provinces and cities:

1. To establish a Steering Board led by the social insurance agency’s director to implement the Government’s Resolution No 116/NQ-CP and the Prime Minister’s Decision No 28/2021/QĐ-TTg.

2. To inform employees and employers of the support policies in line with Decision 28/2021/QĐ-TTg; to publicise the list of eligible employees on social insurance agencies’ portals; to clearly define the responsibility of units; the right to receive or not receive the support of employers and employees.

3. To take responsibility for determining beneficiaries; employee’s total period of unearned unemployment insurance payment.

4. To disseminate support policies in line with the Decision No 28/2021/QĐ-TTg by mass media in the locality.

5. To calculate the support levels for labourers participating in the unemployment insurance system and send to VSS’ Finance and Accounting Department before October 15, 2021.

6. To review and compare data managed by provincial social insurance agencies with data managed by the Information Technology Centre to make a list of employees eligible for support.

7. To instruct units to fill in Form No 2 issued in line with Decision No 28/2021/QĐ-TTg; Form No 3 issued in line with Decision No 28/2021/QĐ-TTg; and instruct employees to fill in the Form No 4 issued in line with Decision No 28/2021/QĐ-TTg, and send to social insurance agencies.

8. To settle procedures to ensure timely, public and transparent support for labourers. Any additional documents and procedures required for the support are not allowed and the time of payment must abide by Decision No 28/2021/QĐ-TTg and VSS’ guidance as stipulated in this Document.

9. To timely receive and settle any inquiries, petitions, and complaints by units and labourers in the implementation of the support policies.

10. To report to VSS the results of the settlement and payment of financial support for employees and employers in accordance with Decision No 28/2021/QĐ-TTg.

11. To take full responsibility for the implementation of support policies in the locality.

For the social insurance agencies of the Ministry of National Defence and People’s Public Security: to specify procedures for the implementation of support policies based on special features in their organisation and activities.

Heads of the units under VSS and directors of Central provinces and cities’ social insurance agencies, on the basis of their functions and duties, must seriously implement support policies and be accountable before VSS’ Director General for the implementation of Resolution No 116/NQ-CP, Decision No 28/2021/QĐ-TTg and this Document. In this process, if there are any inquiries, social insurance agencies of Central provinces and cities, social insurance agencies of the Ministry of National Defence and People’s Public Security must quickly report to VSS to settle any obstacles.
