Implementation of the Constitution: Human and citizens’ rights are guaranteed

The Government has just submited the reported No. 458/BC-CP on a preliminary review of 5 years of implementing the 2013 Constitution (2014-2019) to National Assembly. Accordingly, over time, from the values of the Constitution, the legal system has been improved to a higher level.

The 2013 Constitution was born to reflect the achievements of the process of building and perfecting the legal system after nearly 30 years of conducting the renovation and 8 years of implementing the Strategy for building and perfecting the legal system according to the Resolution No. 48-NQ/TW of the Politburo; creating the highest legal-political basis for the process of building and perfecting the legal system.

In particular, issues such as promoting people's sovereignty and direct democracy emerged; assign, coordinate and control the state power; human rights and citizens' rights are recognized, respected, protected and guaranteed by the State.

Over the past years, the National Assembly's law and ordinance making program has an appropriate proportion of laws and ordinances project on human rights and citizens' rights. By the end of June 2019, the National Assembly has enacted 11 out of 16 laws on human rights, basic rights and obligations of citizens.

Human rights and citizens' rights belong to the group of civil and political rights such as the right to stand for election and to vote; right to participate in state management, social management; voting rights when the state held a referendum, etc. were specifically concerned through the promulgation of the new Law on Election of National Assembly deputies and People's Council deputies, the Law on Promulgation of legal documents , Law on Referendum, Law on Access to Information, Law on Press, Law on Beliefs, religion, etc., ensuring the legal system on human rights and citizens' rights is getting better and better.

Human rights and citizens' rights in economic and social rights groups have been concretized in laws of economic, cultural and social fields. The Law on Enterprises, the Law on Investment, the Law on Civil Status, the Law on Citizenship Identification, the Law on Health Insurance, the Law on Social Insurance, the Law on Marriage and Family, etc. have been issued, amended and supplemented in a timely manner to ensure recognition and specify regulations on the implementation mechanism, better protect human rights in the field of civil, labor, marriage and family.

For groups of human rights and civil rights in the judiciary such as the right to inviolability of the body, the right to defense of the arrested, detained, prosecuted, investigated, indicted, adjudicated, equality rights before the law, etc. has also been concretized in important laws such as the Criminal Code, the Criminal Procedure Code, the Civil Procedure Code, the Law on Administrative Procedure, the Law on Criminal Enforcement, etc. In particular, the promulgation of the Criminal Code and the Criminal Procedure Code has helped our State and people have more sharp and effective legal instruments in preventing and combating crimes and showing humanity in the crime prevention of our Party and State, at the same time promoting the effectiveness of crime prevention in the new situation, contributing to the protection and promotion of human rights.
