President's Order Annoucement on 11 New Laws

In the afternoon of December 16, the President's Office held a press conference to announce the President's Order Annoucement on 11 new Laws passed by the 14th National Assembly at the 8th session.

Chairman of the President's Office Dao Viet Trung chaired the press conference.

Accordingly, 11 laws were published including: Labor Code, Library Law, Law on Exit and Entry of Vietnamese Citizens, Law on Militia and Self-Defense Force; Law amending and supplementing a number of articles of the Law on Organization of the Government and the Law on Organization of Local Governments; Law amending and supplementing a number of articles of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam; Law amending and supplementing a number of articles of the Law on Management and Use of Weapons, Explosives and Supporting Tools; Law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Public Employees; Law amending and supplementing a number of articles of the State Audit Law; Law on The Reserve Force; Securities Law.

These laws take effect from July 1, 2020, except for the Labor Code and the Securities Law that take effect from January 1, 2021, and the Law amending and supplementing a number of articles of the Law on Management and Use of Weapons gas, explosives and combat gears effective from 10/01/2020.

Among the published Laws, the Law Amending and Supplementing a Number of Articles of the Law on Cadres and Civil Servants and the Law on Public Employees and the Labor Code attracts the attention of the society.

Introducing the new points of the Labor Code, Minister of Labor, Invalids and Social Affairs - Dao Ngoc Dung said that the Labor Code with 17 chapters and 220 articles had many major amendments and additions. In which, the scope of adjustment has been extended to both employees with labor relations of nearly 20 million people and employees without labor relations. Extend protection to juvenile workers in both the formal and informal sectors, and juvenile workers without working relationships.

Regarding retirement age, the Code has institutionalized Central Resolution No. 28-NQ/TW on reforming social insurance policies, adjusting the general retirement age according to the schedule: under normal working conditions, men retire at the age of 62 (in 2028) and women retire at the age of 60 (in 2035) according to the roadmap of increasing every 3 months for women and every 4 months for men since 2021.

Regarding the Law amending and supplementing a number of articles of the Law on Cadres and Civil Servants and the Law on Officials, Deputy Minister of Home Affairs - Nguyen Duy Thang said: The Law amends and supplements a number of articles of the Law on Cadres and Civil Servants and The Law on Officials supplementing and assigning the Government to provide specific regulations for officials and public employees after their work is retired or retired before detecting violations during their working time (applicable to those who have committed violations before 7/1/2020) shall, depending on the nature and seriousness of their violations, be subject to one of the forms of disciplinary reprimand, warning or removal of the positions they have assumed; attach legal consequences corresponding to the form of disciplinary action.

Regarding discipline of cadres and civil servants, the time limit for disciplinary actions is 90 days and 150 days for complicated cases instead of the current regulations of 60 days and 90 days. Clearly specify the appointment when disciplined, not to appoint to a higher position within 12 months if subject to disciplinary reprimand, warning, lower salary level; Do not appoint a position within 24 months if subject to demotion.

Notably, the revised Law stipulates the application of signing a working contract with a term of between 12 months and 60 months for newly recruited employees after July 1, 2020, except for cases where the officers are recruited to work in areas with extremely difficult socio-economic conditions, the indefinite-term working contract regime will still be applied.
