New regulations on working positions and the number of people working in public non-business units

On September 10, 2020, the Government issued Decree No. 106/2020/ND-CP on working positions and the number of people working in public non-business units, which takes effective from November 15, 2020.

Decree 106/2020/ND-CP on regulating the positions and number of workers will take effect from November 15, 2020.

According to the Decree, the principle of determining the working positions and the number of employees must be consistent with the functions, duties, powers and organizational structure of the public non-business units; ensure sciencetificness, equitability, openness, transparency, efficiency, and improve the quality of the contingent of public employees and workers in public non-business units; guarantee a sufficient amount of work assigned to a worker according to the prescribed labor time.

The positions without sufficient work volume to perform according to the prescribed time of one person must have a plurality arrangement. Simultaneously, an appropriate structure must be ensured, in which the number of people with working positions as general job titles accounts for at least 65% of the total number of people working in public non-business units.

There are 2 bases for determining working positions and 3 ones for the number of people working in public non-business units. Specifically:

The bases for determining job positions include:

+ Functions, duties, powers, organizational structure of public non-business units;

+ The degree of complexity, nature, characteristics and scale of the operation; scope and object of service; professional management process according to the provisions of specialized law.

The bases for determining the number of employees include:

+ Working positions and actual work volume at each position of the public non-business units;

+ The level of modernization of offices, equipment, working facilities and information technology application;

+ Management and use status of the unit's assigned workforce.

The Decree also stipulates, by the end of June 30, 2021, Ministers in charge of sectors and fields must issue documents guiding the positions of managerial leadership and job titles, civil servant structure according to titles and norms of the number of people working for public non-business units in the sectors or fields assigned to management. The Minister of Home Affairs shall promulgate documents guiding general job titles as well as support and service of public non-business units.

No later than 3 months from the date the Minister of appointed sectors or fields and the Minister of Home Affairs promulgates the guiding documents, the ministries, branches and localities must approve the job positions and the structure of public employees according to the job titles of public non-business units under their management.

Decree No. 106/2020/ND-CP will come into force from November 15, 2020 and replace Decree No. 41/2012/ND-CP dated May 8, 2012 prescribing the positions of jobs in public non-business units./.
