Amendments to regulations on penalties for administrative violations in the field of labor and social insurance

Amending and supplementing Decree No. 28/2020/ND-CP dated March 1, 2020 of the Government providing penalties for administrative violations in the fields of labor, social insurance, and overseas manpower supply under contract is one of the contents of the Implementation Plan of the Convention No. 98 by International Labor Organization (ILO) on the Right to Organise and Collective Bargaining recently approved by the Prime Minister (PM).

According to the Plan, in 2021-2022, the Ministry of Labor, War Invalids and Social Affairs (MOLISA) shall assume the prime responsibility for, and coordinate with relevant ministries and branches in, reviewing and completing regulations related to applicable sanctions as well as measures to overcome consequences for discriminatory acts against the representative organization of workers more severely in order to deter the employer's discriminatory behavior against the representative organization of employees.

Moreover, review to supplement regulations related to applicable sanctions and remedial measures for acts of interfering and manipulating representative organizations of employees in a stricter direction to deter for acts of interfering and manipulating the employer's representative organization of employees; review and finalize regulations related to applicable sanctions as well as remedial measures for violations of collective bargaining.

In addition, the relevant ministries and branches also carried out a number of tasks such as internalizing the provisions of Convention No. 98, perfecting the system of relevant domestic legal documents for full and comprehensive implementation of the provisions and standards of Convention No. 98.

To effectively perform the tasks according to the Implementation Plan of Directive No. 37-CT/TW dated September 3, 2019 of the Secretariat of the Party Central Committee on strengthening the leadership and direction of building labor relations harmoniously, stably and progressively in the new situation; to research and build a feasible and effective industrial relation model on the basis of collective bargaining that is promoted in a substantive and effective manner in practice.

To train and enhance capacity for stakeholders involved in collective bargaining, including the labor-invalids and social sector, the Vietnam General Confederation of Labor, the Vietnam Chamber of Commerce and Industry, the Vietnam Cooperative Alliance, business associations, employees and employers in enterprises.

To build and provide information and data on labor market and labor relations to support effective collective bargaining.

To strengthen the capacity of labor inspectors and competent agencies, organizations and individuals to settle labor disputes in order to prevent, detect and handle discriminatory acts against organizations representing workers and employers and acts of interfering and manipulating representative organizations of employees and employers; to effectively settle related complaints and lawsuits, ensuring the rights and interests of the parties; to promote voluntary collective bargaining.
