HN Social Insurance Agency continues co-operating with relevant sectors to ensure labourers’ legal rights

Ha Noi Social Insurance Agency, under Viet Nam Social Security, will co-operate with relevant sectors of the city to strengthen review and finish legal documents to prosecute employers that allegedly commit fraud involving social, health and unemployment insurance or intentionally delay the payment of social insurance for employees.
The move aims to continue ensuring the implementation of the law on social and health insurance and the legal rights of labourers in the capital.
Data from the Viet Nam Social Security showed that Ha Noi is one of the localities with the largest number of businesses participating in social, health and unemployment insurance nationwide. However, the number of businesses delaying the payment of social insurance for their employees in Ha Noi is also higher than the country’s average.
Previously, with efforts to reduce the number of employers who delayed payment of social insurance for their employees, the agency signed inter-sectoral Regulation No 1460/QCPH-CA-LĐTBXH-LĐLĐ-CT-BHXH with the Police Department, the Labour, Invalids and Social Affairs Department, the Confederation of Labour and the Tax Department on June 21, 2017 to ensure the legal rights of labourers in the city in the 2017-20 period.
Under the regulation, the agency worked with the labour department to compile statistics on the total number of labourers working in the city. Based on the data, the agency made plans to expand the participation of social insurance.
The labour department was assigned to direct Ha Noi Job Service Centre to disseminate and mobilise people to participate in voluntary social insurance.
The tax department was told to provide data on the number of newly-established businesses in the city each quarter to review the numbers of labourers that had yet to participate in social insurance.
The labour confederation was responsible for directing trade unions to disseminate legal policies on social and health insurance to both employers and employees to encourage them to fully and promptly participate in social and health insurance.

The police department would investigate, verify and prosecute if finding any individuals or organisations committing fraud involving social insurance or intentionally delaying the payment of social insurance for employees. The police department also co-operated with the People’s Court and the People’s Procuracy of the city to prosecute violators and deter other employers from violating regulations.
Before handing over the documents to the police department for prosecution, the social insurance agency invited businesses that delayed the payment of social insurance for their employees to mobilise them to finish the payment and told them about penalties they would receive following articles of 214, 215 and 216 of the Penal Code.
The People’s Committee of the city issued Document No 5755/UBND-KGVX in December 2020 on enhancing the implementation of measures to collect delayed payments of social and health insurance. The document said if a local business wanted to be honoured for its contribution or participate in project bidding in the city, the business had to get a certificate from the social insurance agency to confirm it did not violate the law on social and health insurance./.
