Gov’t issues decree regulating administrative procedures’ electronic interconnection

On June 10, 2024, the Government issued Decree No 63/2024/ND-CP regulating the implementation of electronic interconnection of two groups of administrative procedures.

The administrative procedures consist of birth registration, permanent residence registration and issuance of health insurance cards for children under six years old; death registration, cancellation of permanent residence registration, settlement of burial fees and funeral allowances.

The implementation of electronic interconnection of administrative procedures for resolving funeral allowances and death allowances is carried out by Viet Nam Social Security. The implementation applies to deceased individuals who were receiving pensions, monthly social insurance allowances, or participating in voluntary social insurance.

The implementation of electronic interconnection of administrative procedures for resolving burial expenses, funeral allowances and death allowances is carried out by the Ministry of Labour, Invalids and Social Affairs. He practice applies to deceased individuals receiving social welfare policies or individuals, who have made contributions to the revolution.

The decree outlines the specific responsibilities of various agencies providing interlinked administrative procedures, including the Ministry of Justice, Ministry of Public Security, Ministry of Labour, Invalids and Social Affairs, Ministry of Health, Ministry of Information and Communications, Government Office, healthcare facilities, People's Committees at levels of province, district and commune, as well as the Viet Nam Social Security.

Accordingly, the Viet Nam Social Security holds the responsibility of ensuring the efficient functioning of social insurance industry's information system. This includes guaranteeing smooth connectivity with the national public service software and synchronising the status of receiving, processing and resolving files with the national public service software.

The agency also has to take responsibility of supporting technical infrastructure for connecting and sharing electronic birth registration data, death reports between healthcare facilities and the national public service software while the health ministry's healthcare database is not yet complete; sharing electronic birth registration data, electronic death reports belonging to the two groups of electronically interlinked administrative procedures with the health sector's database.

Additionally, the agency was tasked to provide guidance to social security offices at all levels in receiving, processing and delivering results of interlinked administrative procedures; coordinating with local authorities in resolving the interlinked administrative procedures.

The decree came into force from the date of issuance.

From the valid date of the decree until July 1, 2024, the administrative-procedure handling systems at the ministerial and provincial levels, as well as the business software of ministries, sectors and localities must be upgraded to connect, share with the national population database, the national administrative procedure database, the national insurance database, specialised databases, and the national public service software as stipulated in the decree.

From July 1, 2024, files for the two groups of electronically interlinked administrative procedures will be received and resolved according to the provisions of the decree.

Implementation procedure

The decree specifies the composition of the files, methods of file submission, and process of receiving, resolving and delivering results for electronically interlinked administrative procedures.

Accordingly, submitting files is convenient for applicants while they only need to access the National Public Service Portal at dichvucong.gov.vn or on the VNeID application, select the "Interconnected birth registration, death registration service" to submit online files and pay fees as required.

Regarding processing time, for the group of interlinked administrative procedures "Birth registration, permanent residence registration, issuance of health insurance cards for children under six years old", the processing time will not exceed three working days since the date that the competent authorities receive complete files according to regulations, and in cases requiring verification, it will not exceed five working days.

Processing time for the group of interlinked administrative procedures "Death registration, cancellation of permanent residence registration, settlement of burial fees and funeral allowances", resolving funeral assistance, death allowances for the group of people who contributed to the national revolution, will not exceed 18 working days; resolving burial expense for the social welfare beneficiaries group will not exceed six working days; resolving burial expense will not exceed 11 working days for cases of individuals aged 80 or older receiving monthly death allowances.

Funeral support and death allowances for people, carried out by the Viet Nam Social Security, will not exceed nine working days.

Delivery of administrative procedure results by paper documents will be implemented at the One-stop shop of administrative procedure at agencies or via postal services according to the request of the applicant.

Delivery of administrative procedure results by electronic documents will be automatically sent by systems to applicants through the electronic data management repository of organisations, individuals on the National Public Service Portal, VNeID application, and administrative procedure resolution information system at ministerial, provincial levels./.
