VSS and the Korean National Pension Agency signed an Agreement on implementating the Social Insurance Agreement

On the afternoon of January 23rd, the online signing ceremony of the Agreement to implement the Social Insurance Agreement between Vietnam Social Security (VSS) and the Korean National Pension Agency (NPS) took place. Deputy General Director of VSS Dao Viet Anh and Deputy Executive General Director of the Korean National Pension Agency Kim Jeong Hark co-chaired the signing ceremony. Attending the signing ceremony were representatives of the Ministry of Labor, Invalids and Social Affairs and leaders of a number of units under Vietnam Social Security.

Speaking at the Signing Ceremony, Deputy General Director of VSS Dao Viet Anh said, according to Decision No. 36/QD-TTg of the Prime Minister on approving the Plan to implement the Agreement between Vietnam and Korea on social insurance, VSS is assigned to be the focal agency, directly implementing the Agreement; actively coordinate with the Korean implementing agency to discuss and agree on the contents included in the draft Administrative Agreement, and report to the competent state agency on the Vietnamese side to discuss and sign the administrative Agreement with competent state agencies of Korea, serving as a basis for the social insurance agency to organize the implementation of the Agreement.

To carry out the above task, VSS has coordinated with NPS to complete the content of the Administrative Agreement between the two countries on social insurance. On December 8th, 2023, in Korea, Deputy Minister of Labor, Invalids and Social Affairs of Vietnam Nguyen Ba Hoan and Deputy Minister of Health and Welfare of Korea Kim Hyejin signed an Administrative Agreement to implement the Agreement between the Government the Socialist Republic of Vietnam and the Government of the Republic of Korea on social insurance.

According to Deputy General Director Dao Viet Anh, the signing of the Administrative Agreement is an important step to set out specific regulations and solutions so that the two countries' authorities shall implement the Agreement in accordance with the principles and contents signed between the two Governments; at the same time, ensuring maximum convenience for state management agencies, implementing organizations, businesses and employees of both sides.

On behalf of the leaders of VSS, Deputy General Director Dao Viet Anh expressed his sincere thanks to NPS for recently coordination with VSS to complete the contents of the Administrative Agreement between the two sides. At the same time, he believes that, through the contents signed by the two sides today, the two sides shall ensure the legitimate rights and benefits of social insurance for employees of the two countries, contributing to building a fair and sustainable social security system.

In Jeonju (Korea), Mr. Kim Jeong Hark – Deputy Executive General Director in NPS also expressed his sincere thanks to VSS for accompanying NPS in establishing the framework of the Agreement to implement the Social Insurance Agreement between the two countries. “We appreciate the close coordination of VSS; at the same time, expressed agreement to continue to cooperate to fully and effectively implementing the contents of the Agreement and Administrative Agreement" - Mr. Kim Jeong Hark shared.

According to the contents of the Agreement, the two parties agree that the dispatched laborer will not participate in the other contracting party's social insurance during the period stated in the Certificate of Social Insurance Subjects. The exemption from social insurance will be approved when the employer or employee submits an original copy of the Social Insurance Subject Certificate issued by the implementing agency of both parties. The two sides also agreed that if the dispatched worker returns home due to being mobilized or the labor contract ends and is dispatched again, this dispatch will be considered a new dispatch and the exemption period will be recalculated.

In addition, the two sides agree to exchange information by using the fastest methods in case the respective laws change that have affection on the application of the Agreement, and necessary data is amended and supplemented to improve working processes of both implementing agencies, problems arising during the implementation of the Agreement and Administrative Agreement...

The signing of the Agreement to implement the Agreement and the Administrative Agreement between VSS and NPS will create favorable conditions for workers from both countries when moving to work in each side's territory, protecting social insurance rights for workers of the two countries. In addition to providing regulations on avoiding double payment of social insurance, employees of the two countries shall  be able to accumulate their time participating in social insurance in both Vietnam and Korea as a basis for calculating retirement benefits./.
