Updated guidance on support for unemployed workers whose working hours are reduced

The Vietnam General Confederation of Labor has just issued Decision 6696/QD-TLD promulgating the regulation on the implementation of policies to support trade union members and employees whose working hours are reduced or their labor contracts terminated by enterprises suffering from the number of orders being cut down.

Specifically, employees who have their daily working time reduced, or have the number of working days in a week or month reduced (except in the case of a reduction in overtime), or have been suspended from work from October 1, 2022 to the end of March 31, 2023 with any monthly income lower than the regional minimum wage, are supported as follows:
- 01 million VND/person for employees who are union members or non-members but are full 35 years old females, pregnant females, nursing biological or adopted children under 06 years old.
- 700,000 VND/person for employees who are not union members.
For employees whose labor contract performance is suspended and unpaid from October 1, 2022 to the end of March 31, 2023, the support level will be:
- 02 million VND/person for employees who are union members or non-members but are full 35 years old females, pregnant females, nursing biological or adopted children under 06 years old.
- 1.4 million VND/person for employees who are not union members.
For employees whose labor contracts are terminated from October 1, 2022 to the end of March 31, 2023 but are not eligible for unemployment benefits:
- 03 million VND/person for employees who are union members or non-members but are full 35 years old females, pregnant females, nursing biological or adopted children under 06 years old.
- 2.1 million VND/person for employees who are not union members.
In case the employee's working hours are reduced or the contract performance is suspended, by the 15th of every month, the grassroots trade union shall review and request the employer to coordinate to compile a list of union members and employees who are eligible for support, and directly send the request to the superior trade union. The deadline for receiving applications is by the end of March 31, 2023.
For enterprises that have not yet established a grassroots trade union, the immediate superior trade union at the grassroots level shall request and coordinate with the employer to compile a list of employees eligible for support and collect dossiers according to the regulations.
In case the labor contract is terminated but not eligible for unemployment benefits, the employee who needs support shall send a dossier to the direct superior trade union at the grassroots level or the provincial trade union at the residential area or where union members and employees terminate labor contracts.
After that, at the trade union where the records of the union members are received, the employees shall check and guide the union members and employees to submit the prescribed dossiers and make a record of receipt of the dossiers of the union members and employees.
The processing time for documents and procedures for employees to receive support is 19-22 days maximum.
The principle of support is that for each case, the employee is paid once in cash or by transfer.
In case union members and employees are eligible for many different support policies according to this regulation, only the policy with the highest level of support will be enjoyed.
In case trade union members and employees have been entitled to a low level of support and then converted to a higher level of support, they will be able to enjoy the difference between the two support levels.
