PM issues a public notice requesting ministries and branches to reduce at least 10% of the number of public non-business units

On February 28, Prime Minister (PM) Pham Minh Chinh signed and promulgated Official Dispatch No. 209/CD-TTg on the arrangement of administrative organizations and public non-business units of ministries, ministerial-level agencies and agencies under the Government, People's Committees of provinces and centrally-run cities.

The official dispatch stated: Implementing the conclusion of the Politburo in Document No. 1108 CV/VPTW dated June 23, 2021 of the Office of the Party Central Committee on the organizational structure of the 15th-tenure Government (2021 - 2026), Resolution No. 32/2021/QH15 dated November 12, 2021 of the National Assembly on the socio-economic development plan in 2022, to promote the arrangement of administrative organizations and public non-business units of ministries, ministerial-level agencies, Governmental agencies (hereinafter abbreviated as ministries and branches), People's Committees of provinces and cities under central authority (hereinafter referred to as localities), the PM shall give opinions only religion as follows:

1. For ministries and branches:

a) Urgently review and speed up the arrangement and streamline the internal organization of ministries and branches according to Notice No. 16/TB-BCDDMSXTCBM dated January 21, 2022 of the Innovation Steering Committee, arrange the organizational apparatus of ministries, ministerial-level agencies and agencies attached to the Government.

On the basis of the review results, the ministries and branches are responsible for developing a draft decree stipulating the functions, tasks, powers and organizational structure of their agencies (enclosed with a scheme on organizational arrangement of their agencies) to the Ministry of Home Affairs and the Ministry of Justice for appraisal; receive, explain and complete the draft decree according to regulations.

In case the contents have different opinions (not yet in agreement with the appraisal opinions of the Ministry of Home Affairs and the Ministry of Justice), the ministries and branches are responsible for reporting and consulting the Steering Committee before submitting to the Government for considering and decision.

The time to send to the Ministry of Home Affairs and the Ministry of Justice to appraise the draft decree and submit it to the Government for consideration and decision shall be in March 2022.

b) Regarding arrangement of other public non-business units (not specified in the Decree defining functions, tasks, powers and organizational structure of ministries and branches):

Request ministries and branches to review, rearrange and reorganize in the direction of: Reducing at least 10% of the number of public non-business units in the spirit of Resolution No. 19-NQ/TW dated October 25, 2017 of the Government. The Sixth Plenary Session of the 12th Central Committee on continuing to innovate and organize the management and improvement of the quality and operational efficiency of public non-business units (hereinafter referred to as Resolution No. 19-NQ/TW). The compact arrangement of non-business units should be based on functions, tasks, criteria and conditions for establishment, inheritance, and promote the results of the implementation of the arrangement in the 2017-2021 period, ensuring the improvement of quality and operational efficiency of public non-business units.

- Only retain units under the ministry serving political tasks and leading units associated with the ministry's functions and tasks that fully meet the criteria and conditions for establishment as prescribed. For other public non-business units, ministries and branches are required to actively coordinate with line ministries to develop plans to transfer to localities or to ministries to manage branches and fields, with a view to unifying the focal point for management, reorganization and restructuring of public non-business units, ensuring compliance with the planning of the network of public non-business units by branch or field.

Promote the autonomy mechanism as required in Resolution No. 19-NQ/TW and the Government's regulations in Decree No. 120/2020/ND-CP dated January 7, 2020 regulating the establishment and reorganization, dissolution of public non-business units, Decree No. 106/2020/ND-CP dated September 10, 2020 on employment positions and the number of people working in public non-business units and Decree No. 60/ 2001/ND-CP dated June 21, 2021 stipulating the financial autonomy mechanism of public non-business units; encourage units to improve their financial autonomy to ensure stability and development.

The time to complete the arrangement of public non-business units is before June 30, 2022.

2. For localities:

a) Regarding administrative organization: Localities shall continue to review and arrange specialized agencies under the People's Committees of provinces and districts and organize the internal apparatus in a streamlined direction, improving the effectiveness and efficiency of state management, ensuring compliance with the Government's regulations in Decree No. 107/2020/ND-CP and Decree No. 108/2020/ND-CP dated September 14, 2020.

b) Regarding public non-business units: Localities shall continue to promote the arrangement of public administrative units under their management, and actively develop plans to receive public administrative units set up by ministries and branches moving to localities and arrange and restructure public non-business units under the guidance of ministries in charge of branches and fields.

- For public non-business units providing basic and essential public administrative services: Continue to promote the autonomy mechanism as required in Resolution No. 19-NQ/TW and the Government's regulations in Decree No. 120/2000/ND-CP dated October 7, 2020 stipulating the establishment, reorganization and dissolution of public non-business units, Decree No. 106/2020/ND-CP dated September 10, 2020 on employment positions and the number of people working in public non-business units and Decree No. 60/2001/ND-CP dated June 21, 2021 regulating the financial autonomy mechanism of public non-business units; encourage units to improve their financial autonomy to ensure stability and development.

- For other public non-business units (not providing basic and essential public administrative services): It is recommended to promote the implementation of the autonomy mechanism in the direction of self-financing of recurrent expenditures or more and convert into a joint stock company when fully meeting the conditions as prescribed in Decree No. 150/2020/ND-CP dated December 25, 2020 of the Government on converting public non-business units into joint stock companies and PM's Decision No. 26/2001/QD-TTg dated August 12, 2021 on the list of industries and fields to convert public non-business units into joint stock companies./.
