The Government: Prescribing the functions, duties, power and organizational structure of Vietnam Social Security

On August 4, 2020, the Prime Minister signed the Decree No. 89/2020/ND-CP on prescribing the functions, duties, power and organizational structure of Vietnam Social Security.

Accordingly, the Decree consists of 4 Chapters and 13 Articles, which takes effect from September 20, 2020 replacing Decree 01/2016/ND-CP on prescribing the functions, duties, power and organizational structure of Vietnam Social Security and partly expires Decree No. 115/2015/ND-CP detailing a number of articles of the Law on Social Insurance on compulsory social insurance.

Vietnam Social Security is a Government-attached agency and has the functions of organizing the implementation of social and health insurance policies; organizing the collection and payment of unemployment insurance money; managing and using funds: social insurance funds, unemployment funds and health insurance funds; inspecting the payment of social insurance, unemployment insurance and health insurance in compliance with the law.

Vietnam Social Insurance Agency is under the management of the Ministry of Labor - War Invalids and Social Affairs in terms of social and unemployment insurance; of the Ministry of Health and the Ministry of Finance in terms of financial mechanism of social insurance, unemployment insurance and health insurance funds.

Position and functions: Vietnam Social Security (VSS) is organized and managed with a vertical, centralized and unified system from the central to local levels, including: VSS at the central level; Social insurance authorities of provinces and cities under central authority are directly under the management of VSS in provinces or centrally-run cities; Social insurance authorities of rural districts, urban districts, towns, provincial cities and centrally run cities under the provincial social insurance agencies in rural districts, urban districts, towns, provincial cities and centrally run cities.

Notably, no district social insurance units are organized in an administrative unit being a city or provincial town where a provincial social insurance office is located in the area. VSS has a General Director and no more than 05 Deputy General Directors.

VSS organizational structure at the central level consists of 21 units: 1. Finance Accounting Department; 2. International Cooperation Department; 3. Inspection Department; 4. Awards and Emulation Department; 5. Finance-Planning Department; 6. Organization and Personnel Department; 7. Legal Department; 8. Fund Investment Department; 9. Internal Audit Department; 10. SI Implementation Department; 11. HI Implementation Department; 12. Contribution Collection - Book and Card Issuance Department; 13. Office (the representative based in Ho Chi Minh City); 14. Institute for Social Insurance Science; 15. Media Center; 16. IT Center; 17. Archive Center; 18. Center for Medical Review and Tertiary Care Payments; 19. Customer Service Center; 20. Training Institute for Social Security Operation; 21. Social Security Magazine.

Units defined from Clause 1 to Clause 13 are supporting units and those specified from Clause 14 to Clause 21 are non-business agencies.

The Finance-planning Department, the Finance Accounting Department, the SI Implementation Department, the Organization and Personnel Department and the Internal Audit Department have 04 divisions; The HI Implementation Department and the Inspection Department have 05 divisions; the Book and Card Issuance Department has 06 divisions; The Office has 09 divisions, including the representative based in Ho Chi Minh City.

VSS has the following duties and power: Propose the Ministry of Labour – Invalids and Social Affairs (MOLISA) to submit to the Government prescribing the functions, duties, power and organizational structure of Vietnam Social Security; Develop and submit proposals of strategies, long-term plans, five-year plans, annual plans and other projects and schemes of the Vietnam Social Security under the authority of the Government and Prime Minister and organize the implementation of those strategies, plans, projects and schemes once they are approved; Organize the implementation of policies on social insurance, unemployment insurance and health insurance; Management and use of social insurance, unemployment insurance and health insurance funds; Specialized inspection of payment of social insurance, unemployment insurance and health insurance; Handle administrative violations in payment of social insurance, unemployment insurance and health insurance premiums in accordance with the law; Implement international cooperation on social insurance, unemployment insurance and health insurance in accordance with the law; Implement bilateral and multilateral agreements on social insurance within the scope of functions and tasks of the social insurance industry according to regulations; Management of the organizational structure, finance, properties; etc.

This Decree takes effect from September 20, 2020 replacing the Government's Decree No. 01/2016/ND-CP dated January 5, 2016 on prescribing the functions, duties, power and organizational structure of Vietnam Social Security, which expires on the effective date of this Decree.

This Decree also invalidates Clause 7, Article 23 of the Government's Decree No. 115/2015/ND-CP dated November 11, 2015 on detailing a number of articles of the Law on Social Insurance on compulsory social insurance from the effective date of this Decree.
