To promptly warn, detect, prevent and strictly handle acts of purchasing social insurance books from employees

On April 27, the Ministry of Labor, War Invalids and Social Affairs issued Official Letter No. 1443/LDTBXH-BHXH to the People's Committees of provinces and cities directly under the Central Government and the Vietnam Social Security on warning and handling the acts of purchasing social insurance books from employees.

Accordingly, it was reported on the mass media about a number of subjects took advantage of the COVID-19 disease situation and workers quitting jobs to collect, buy and sell social insurance books for profiteering policies; especially, there are subjects who even impersonated social security agencies to buy and sell social insurance books.

As a result, the Ministry of Labor, War Invalids and Social Affairs requests Vietnam Social Security to direct local social security agencies to strengthen management and strictly control the payment process to ensure complete and timely payment from appropriate groups of subjects; closely coordinate with local departments and agencies to promote propaganda and dissemination of laws on social insurance to raise employees' awareness, aiming to ensure long-term social security benefits for workers.

In addition, in order to strengthen the management and implementation of social insurance policies and ensure the rights of participants, the Ministry of Labor, War Invalids and Social Affairs proposed the following opinions:

According to Clause 6, Article 18 of 2014 Law on Social Insurance, employees have the right to "Authorize others to receive pensions or social insurance allowances". This regulation aims to create favorable conditions for employees to participate in and benefit from social insurance regimes and fully comply with the provisions of law on civil rights. However, due to the inadequate awareness of the employees, a number of subjects took advantage of the above regulation to approach and entice the employees into the acts of buying and selling social insurance books at a good price attached with letters of confirmation of eligibility to receive social insurance benefits, then conduct payment procedures and enjoy the interest rate difference.

The above-mentioned acts violate the provisions of the social insurance law on the rights of employees "to participate and enjoy the social insurance regimes", "to be granted and manage social insurance books", the right to "receive pensions and social insurance allowances", which are specified in Clauses 1, 2 and 3, Article 18 of the Law on Social Insurance.

Following the guidance of the Standing Deputy Prime Minister Truong Hoa Binh in Document No. 2858/VPCP-NC dated April 12, 2020 of the Government Office, the Ministry of Labor, War Invalids and Social Affairs proposes the People's Committees of provinces and cities directly under the Central Government shall give directions to the relevant departments, branches and agencies to promptly alert, detect, prevent and strictly handle acts of purchasing social insurance books from laborers.
