Government to consider draft Law amending and supplementing a number of articles of the Law on Social Insurance

On August 12, the Government Office announced that, in preparation for the second session of the 16th National Assembly, the Prime Minister has requested ministries and ministerial-level agencies to urgently finalize the dossiers and documents for 17 draft laws and resolutions, to ensure quality and complete them on schedule by August 20, 2026, for submission to the National Assembly Standing Committee. Among them is the draft Law amending and supplementing a number of articles of the Law on Social Insurance (SI), prepared by the Ministry of Home Affairs.

Under the plan, the 17 draft laws and resolutions will be discussed and considered by the Government at the August 2026 thematic Government session on law-making (first session), scheduled for August 18. The Prime Minister requested ministers and heads of ministerial-level agencies to direct the completion of dossiers, documents and the Government's submissions, ensuring they are finalized on schedule to serve preparations for the second session of the 16th National Assembly.

Regarding the draft Law amending and supplementing a number of articles of the Law on SI, the Ministry of Home Affairs has sent an official letter to the Ministry of Justice requesting evaluation. According to the draft Government submission dated July 16, 2026, the amendments aim to further institutionalize the Party's guidelines and policies and the State's laws, while aligning with the practical restructuring of the organizational apparatus of the political system and the organization of two-tier local government.

The draft also seeks to ensure consistency with the authority of the National Assembly and the Government and the principles governing the division of authority among agencies and localities; while providing an additional legal basis for organizations and agencies to implement SI policies and regimes.

The major proposed amendments and supplements focus on regulations related to the restructuring of the organizational apparatus and two-tier local government; SI regimes and policies; facilitating resources and improving the efficiency of SI fund investment; while also reviewing and adjusting the authority of ministers and ministries and agencies in SI.

The urgent completion of the dossier for the draft Law amending and supplementing a number of articles of the Law on SI is being carried out in the context that the 2024 Law on Social Insurance took effect on July 1, 2025. The proposed amendments and supplements are intended to further refine the legal framework for SI, ensuring consistency with the restructuring of the organizational apparatus, decentralization and delegation of authority, and management requirements in the new period./.
