VSS issued Decision 313/QD-BHXH amending and supplementing the procedures for processing and paying SI and UI benefits

On March 27, 2026, Vietnam Social Security (VSS) issued Decision 313/QĐ-BHXH, which amends and supplements several articles of the procedures for processing and payment of SI and UI benefits, as outlined in Decision 2222/QĐ-BHXH from 2025.

Decision 313/QĐ-BHXH focuses on amending and supplementing key contents in Articles 2, 3, 4, 5, 6, and 7 of the process issued together with Decision No. 2222/QĐ-BHXH. It also adds Appendix I and Appendix II, detailing the list of mandatory documents or those replaced by interconnected and shared data.

Intensifying the use of digital data as the primary basis, and minimize administrative paperwork.

The process emphasizes that the settlement of SI and UI benefits must be based on SI books that are synchronized with the nationwide centralized and unified contribution management database. When documents are already available in the SI's database, the national database, or specialized databases (such as electronic civil registration or medical examination), organizations and individuals are not required to resubmit them. The Reception and Results Delivery Unit/Department (Check lại lần nữa cho chắc nhé) and the SI Benefit Department are required to access and verify electronic data before processing. If data cannot be accessed, additional information should be requested, and individuals/organizations should be guided to contact the competent authority to update the data.

The preparation of payment listsfor SI and UI benefits must comply with legal regulations, Decision No.313, and related guidance documents from VSS. Payments must be made accurately to the right person, at the right time, and for the correct amount.

Handling cases where employers have not paid mandatory SI contributions in full.

For employees of employers who have not fully paid the mandatory social insurance contributions, the settlement of social insurance benefits shall be implemented in accordance with the provisions in Clause 3, Article 8 of Decree No. 158/2025/ND-CP dated June 25, 2025, by the Government, detailing and guiding the implementation of several articles of the Law on Social Insurance regarding mandatory social insurance.

Handling inconsistent or incomplete data

In cases where there is no contribution data on the system, or the contribution data on the system and the information on the social insurance book are inconsistent, or the periods of social insurance and unemployment insurance contributions have not been fully confirmed on the social insurance book; or in cases where adjustments, cancellations, terminations, or continuation of benefits are requested but the contribution data has not been adjusted, the case shall be transferred back to the Collection Management Department/Division (according to Form 21-HSB) or coordinated with the the social insurance agency responsible for contribution collection.

Automatic locking of participation records after benefit settlement

After settling benefits such as retirement, survivorship, lump-sum social insurance, monthly allowances, or compiling a list for unemployment insurance payments, the system will automatically lock the corresponding social insurance and unemployment insurance participation records.

Details of the procedures for processing benefits (Appendix I and II)

The list of documents required for sickness benefits, maternity benefits, convalescence benefits, occupational accident and disease benefits, retirement benefits, death benefits, monthly allowances, lump-sum social insurance payments, etc., is specified in detail. Many documents (death certificates, birth certificates, medical examination reports, hospital discharge papers, etc.) are replaced by interconnected and shared data. Appendix II also clearly specifies the documents required for compiling lists for unemployment benefits, vocational training support, and vocational education support according to the new regulations of Decree 374/2025/ND-CP.
