The Social Committee collects opinion on the Social Insurance Law Project (amended) and the Trade Union Law (amended)

On April 8th, in Ho Chi Minh City, the Social Committee organized a workshop to collect opinion on a number of major issues regulated at the Social Insurance Law Project (amended) and the Trade Union Law (amended).

Speaking at the opening of the Workshop to collect opinions on a number of major issues regulated at the Trade Union Law project (amended), Chairman of the Social Committee Nguyen Thuy Anh said, under the Program for developing laws and ordinances in 2024, the proposed Trade Union Law (amended) shall be submitted to the National Assembly for voting initial opinion at the 7th Session and for considering for approval at the 8th Session.

Emphasizing that the current Trade Union Law was promulgated in 2012, after more than 10 years of implementation, revealing various limitations and inadequacies, Committee Chairman Nguyen Thuy Anh said that amending the Trade Union Law is necessary to institutionalize the Party's policies and guidelines on innovating the organization and operations of trade unions; At the same time, solve problems and shortcomings from practice; as well as in accordance with international practices.

Giving comments at the conference, delegates highly appreciated the necessity and appropriateness of amending the Trade Union Law, especially when the 2019 Labor Code took effect from January 1st, 2021, including many contents  on labor relations and the rights of workers to participate in representative organizations have been amended, supplemented. Along with that, in the context of deep international economic integration, Vietnam has joined new generation free trade agreements with its commitments to comply with basic principles and rights in labor in accordance to international labor laws. Conventions of the International Labor Organization (ILO), including ILO Convention No. 98 on the rights on Organizing  and Collective Bargaining.

Delegates focused on giving comments on: The right to establish, join and operate trade unions; Supervise activities of agencies, organizations and enterprises; State responsibilities for trade unions; joining the Vietnam Trade Union of workers' organizations at the enterprise; ensure staff organization; Handle violations of trade union laws; Trade union financial mechanism in the context of in-depth international integration and the birth of employee organizations at enterprises outside the Vietnam Trade Union system...

Chairman of the Social Committee Nguyen Thuy Anh said that regulations on one-time social insurance benefits are one of the key contents to be revised in the Social Insurance Law project (amended). This is a big, important issue. The Chairman of the Social Committee requested experts, beneficiaries, people who have received one-time social insurance, employers, grassroots trade unions... to contribute their opinions to find the optimal, feasible solutions to solve these curent problems, having a long-term impact, is consistent with the actual situation, as well as meets development requirements.

Regarding the regulation on one-time social insurance benefits, the draft Law proposes two options. Option 1, workers are divided into two groups. For Group 1 : Continue to be eligible for one-time social insurance benefits as stipulated at Resolution No. 93/2015/QH13 dated June 22nd, 2015 of the National Assembly on implementing the policy of one-time social insurance benefits for employees: For employees participating in social insurance before the Law shall take effect (expected July 1, 2025), after 12 months, the ones shall not be eligible to participate in compulsory social insurance or not participate in voluntary social insurance.

For Group 2, employees participating in social insurance from the date that the Law took effect, are not eligible to apply this regulation.

Option 2: The employee will receive partial compensation but not exceeding 50% of the total time paid into the Retirement and Survivorship Fund. The remaining social insurance payment period is reserved so that employees can continue to participate and enjoy social insurance benefits.

At the Workshop, delegates also shared the current situation of supporting workers who have lost their jobs; Propose and recommend completing regulations on one-time social insurance in the Draft Law on Social Insurance (amended). Employee representatives also shared many thoughts, aspirations and opinions about the issue of one-time social insurance benefits...
