New regulations on adjusting monthly salary and income after payment of social insurance premiums

The Ministry of Labor, War invalids, and Social affairs issued Circular No. 20/2023/TT-BLDTBXH regarding the adjusting rates for monthly salary and income on which social insurance premiums have been paid. These regulations are effective from January 1, 2024.

The first group refers to persons whose salaries, on which social insurance premiums have been paid, are adjusted as stipulated in Clause 1 and Clause 2 of Article 10 of Decree No. 115/2015/ND-CP, including :
Employees who subject to the State-prescribed salary regime and began participating in social insurance from January 1, 2016, receive lump-sum social insurance allowance or died and their relatives are entitled to enjoy a lump-sum survivorship allowance during the period from January 1, 2024 to December 31, 2024.
Employees who pay social insurance premiums according to the employer-decided salary regime, those on pension, lump-sum allowances upon retirement, lump-sum social insurance allowance, or death and their relatives are entitled to a lump-sum survivorship allowance during the period from January 1, 2024, and December 31, 2024 (hereinafter referred to as the first group of subjects).
The second group refers to persons whose monthly incomes, on which social insurance premiums have been paid, are adjusted as stipulated at Clause 2 of Article 4 of Decree No. 134/2015/NĐ-CP, including voluntary social insurance participants on pension, lump-sum allowances upon retirement, lump-sum social insurance allowance, or died and their relatives are entitled to a lump-sum survivorship allowance during the period from January 1, 2024 to December 31, 2024 (hereinafter referred to as the second group of subjects).
The document specifies that the salary on which social insurance premiums have been paid, concerning the first group of subjects as stipulated at this Circular, is adjusted according to the following formula:

For employees who have both a period of social insurance premiums payment under the State-prescribed salary regime and a period of social insurance premiums payment under the employer-decided salary regime, the monthly salaries based social insurance premiums shall be adjusted according to the provisions of Clause 1 of this Article for employees who began participating in social insurance under the state-regulated salary regime from January 1, 2016 onwards and the monthly salaries for which social insurance contributions are paid under employer-decided salary regime.
Adjustment of monthly income on which social insurance premiums have been paid
The monthly income on which social insurance premiums have been paid for the subjects specified at Clause 2 of Article 1 of this Circular shall be adjusted according to the following formula:
Post-adjusting monthly income as the basis for social insurance premiums payment of a year
Total monthly income as the basis for social insurance premiums payment of a year
Adjusting rate of monthly income on which social insurance premiums have been paid of the year
In which, the adjusting rate of monthly income on which social insurance premiums have been paid for the corresponding year is carried out according to Table 2 below:
For employees who pay both compulsory social insurance and voluntary social insurance premiums, the monthly income subject to voluntary social insurance premiums shall be adjusted according to the provisions specified in Clause 1 of this Article; while the monthly salaries on which compulsory social insurance premiums shall be adjusted according to the regulations in Article 10 of Decree No. 115/2015/NĐ-CP and Article 2 of this Circular.
The average monthly salary and income on which social insurance premiums have been paid as the basis for calculation of pension, lump-sum allowance upon retirement, lump-sum social insurance allowance, and lump-sum survivorship allowance, as regulated in Clause 4 of Article 11 of Decree No. 115/2015/NĐ-CP and Clause 4 of Article 5 of Decree No. 134/2015/NĐ-CP.
The Circular takes effect from February 15, 2024. The provisions of this Circular shall apply from January 1, 2024.
Circular No. 01/2023/TT-BLĐTBXH dated January 3, 2023, issued by the Minister of Labor, Invalids and Social Affairs, shall expire upon the effective date of this Circular.
