Under the continued program of the 32nd Session, on the afternoon of the 22nd April, the National Assembly Standing Committee reviewed the Report on summarizing the results of supervision of legal documents in the areas under the responsibility of the Ethnic Council and the NA’s Committees in 2023. Vice Chairman of the National Assembly Nguyen Khac Dinh chaired the meeting.

At the meeting, the National Assembly Standing Committee heard General Secretary of the National Assembly, Head of the National Assembly Office Bui Van Cuong present a summary report summarizing the results of supervision of legal documents by the Council of Nationalities and 2023 Congressional Committees.

Basically, the content of promulgated legal documents ensures the constitutionality, legality, and consistency of the legal system. The NA’s agencies have affirmed that there are 6 documents with signs of contravention of the law and 7 documents that do not ensure the unity and synchronization of the legal system or have problems and inadequacies that could creates loopholes in management that need to be reviewed and comleted. There are documents that have not been specifically guided in their content, and there is no consistency of legal documents, causing difficulties in implementation.

According to reports from NA’s agencies, there are still many documents that provide detailed guidance was issued later than the effective date of laws, ordinances, and resolutions. Specifically, out of 325 documents monitored, there are 32 documents issued later than the effective date of laws, ordinances, and resolutions; In which the document is at least 14 days late, the document is at most 35 months and 24 days late, and some documents are late from 22 to 25 months. In addition, there are 83 articles and clauses belonging to 24 laws, 1 ordinance, 5 resolutions providing detailed regulations but no documents have yet been issued...

In addition to the results achieved, the supervision of legal documents by some agencies has not been carried out regularly, and has not been proactive and timely in detecting and recommending the agencies to promulgate documents to correct shortcomings and violations in promulgating documents and report remedial results to the National Assembly Standing Committee as regulated. Although the slow issuance of documents has been remedied, it still remained. There are still outstanding documents and documents whose content does not ensure the synchronization and consistency of the legal system. The Ethnic Council and National Assembly Committees strengthen control over the content of detailed regulations in law projects, resolutions and ordinances assigned to preside over inspection; In the process of examining, receiving and revising draft laws, ordinances and resolutions, it is necessary to clearly define the scope and content of detailed regulations in accordance with the provisions of the Law on Promulgation of Legal Documents; Regularly monitor and urge the implementation of monitoring conclusions and recommendations. Basically, the opinions agreed with the summary report to summarize the results of supervision of legal documents in the areas of responsibility of the Ethnic Council and Committees of the National Assembly in 2023 by the Secretary General of the National Assembly, Chairman of the National Assembly Office Bui Van Cuong presented; At the same time, he spoke and added some content about the results of monitoring legal documents in the field of responsibility, serving to complete the official report.

Concluding the discussion, Vice Chairman of the National Assembly Nguyen Khac Dinh said that besides the results achieved, the supervision of some agencies is still limited. Therefore, based on the results of this supervision, the National Assembly Standing Committee assigned agencies to continue to better supervise legal documents. Promoting the role of the Standing Committee of the Nationalities Council and the Standing Committees of the National Assembly to assist the National Council and Committees of the National Assembly examine, absorb and revise draft laws and ordinances, resolution. During the process of acquisition and revision, it is necessary to clearly define the content of the assigned scope of detailed regulations in accordance with the provisions of the Law on Promulgation of Legal Documents; Consider and evaluate the quantity and quality of draft detailed regulatory documents and documents, and the progress of developing detailed regulatory documents to limit the delay in promulgating detailed regulatory documents. At the same time, proactively supervise and urge the agency in charge of drafting and constructing to promptly promulgate detailed regulatory documents, ensuring the constitutionality, legality, and consistency of the legal system and compatible with international treaties to which Vietnam is a member.

Overview of the meeting

Combine legal document supervision activities with other supervision such as thematic supervision, conduction of explanations, review of letters, complaints and denunciations, and review of legal documents to deeper analyze and evaluate more specifically the content of the document, especially the feasibility, as well as the socio-economic impact of the slow promulgation of documents or the promulgation of documents that are not constitutional and do not ensure the uniformity of the legal system.

After this session, Vice Chairman of the National Assembly Nguyen Khac Dinh requested the General Secretary of the National Assembly to receive the opinions of the National Assembly Standing Committee, the opinions of relevant agencies, and exchange opinions with the Ethnic Council and relevant agencies on issues that need to be supplemented, completed, and clarified to build a synchronous, unified, and fully informed report of the agencies and send to National Assembly deputies and the other concerned implementation agencies. For the areas where there are errors, contradictions, overlaps, and infeasibility are detected, detecting agencies need to directly work with agencies to handle and report to the National Assembly Standing Committee./.
