What is the quantity and composition of the dossier for 'Settling the enjoyment of maternity benefits for employees who have left work before giving birth or adopting a child'?
Based on point 2.2, clause 2, Section III of the Appendix accompanying Decision No. 896/QD-BHXH of the Director-General of Vietnam Social Insurance, the quantity of the dossier for 'Settling the enjoyment of maternity benefits for employees who have left work before giving birth or adopting a child' is 01 set; the components of the dossier (if not specified as originals, valid copies can be submitted) are as follows:
In case of giving birth or adopting a child:
Copy of Birth Certificate or Birth Extract or Copy of Child's Certificate.
In case the child dies after birth: a copy of the Birth Certificate or Birth Extract or a copy of the Child's Certificate, a copy of the Death Certificate or Death Extract or a copy of the Child's Death Notice; in case the child dies immediately after birth without being issued a Birth Certificate, it is replaced by an extract from the medical records or a summary of the medical records or a copy of the discharge papers of the mother or the pregnant worker proving the child's death.
In case the mother or pregnant worker dies after giving birth, there is an additional copy of the Death Certificate or Death Extract of the mother or pregnant worker.
In case the mother, after giving birth, or the pregnant worker who entrusts pregnancy for adoption, is no longer healthy enough to care for the child, there is an additional Decision of the Assessment Council.
In case of taking leave for prenatal care according to the provisions of Article 31, Clause 3 of the Social Insurance Law No. 58/2014/QH13, one of the following documents is added:
In case a pregnant worker or adopting mother gives birth or the pregnant worker who entrusts pregnancy for adoption receives a child, there is an additional copy of the surrogacy agreement for humanitarian purposes as prescribed in Article 96 of the Law on Marriage and Family in 2014; a document confirming the time of handing over the child from the surrogate and the adopting mother.
In case of paying the assessment fee, there is an additional invoice, receipt for the assessment fee; a list of the contents of the assessment by the facility performing the assessment.
In case of adopting a child under 06 months old: Copy of the Foster Care Certificate.
