I have submitted a dossier to receive unemployment benefits in province A and the appointment date of returning the result was on August 14, 15, and 16, 2020. As I had to move to province B and was unable to return to province A during the time I need to receive the money, I have to go to the Employment Services Center in Province A to ask about canceling the application for unemployment benefits in province A and making a new one in province B. I was advised to wait until the end of August 16, 2020. This means after this date, my application will be automatically canceled and I can receive the unemployment benefits in province B after August 16, 2020. Is that right?
Under the provisions of Clause 1, Article 22 of Decree No. 28/2015/ND-CP: Employees who have received at least 01 month of unemployment allowance as prescribed and need to transfer the unemployment benefits to central-affiliated cities and provinces must request in writing to transfer the unemployment benefit in the form defined by the Minister of Labor, War Invalids and Social Affairs and submit to the employment service center where they are receiving the unemployment benefits.
Pursuant to Article 7 of Circular No. 28/2015/TT-LĐTBXH, In your case, while waiting for the unemployment benefit settlement and you want to receive the allowance in another province, you can directly submit a dossier for non-entitlement to unemployment allowance to the Employment Service Center to get your application for unemployment allowance back and reapply at the place you want to receive the money or you can wait until August 16, 2020. After this date, your application will be automatically canceled as prescribed in Clause 8 Article 1 of Decree No. 61/2020/ND-CP. You may come to receive your claim dossier together with the cancelling decision after 02 working days from the date of expiration of the receiving decision to submit the dossier to claim the unemployment allowance in province B.
