My company had a case of an employee having a traffic accident on the way home from work. As the accident occurred on a deserted road, after the accident, people took him/her to the emergency without calling the local police to come for the record of the accident. They only went to the police station to ask for a confirmation of the incident. On the company’s side, they agreed to review this case under the occupational accidents and sent the employee for injury assessment, the level of injury was 10%. But when my company sent the dossier to the social insurance agency in the area, it was not approved for settlement and they required the record from the police agency at the time of the accident. I would like to know that if this case can be resolved under the occupational accident regimes. Sincerely thank you!

Dossier for settlement of occupational accident benefits for the employee whose treatment is completed after being discharged from hospital before July 1, 2016 according to regulations includes:

1. Social insurance book.

2. In case of traffic accident which is determined as occupational accident, the additional papers are required: Record of scene examination and traffic accident scene diagram; Record of traffic accident of police body or army criminal investigation body.

3. Certificate of discharge after stable treatment of injury of occupational accident in case of inpatient treatment or papers of initial examination and treatment in case of outpatient treatment.

4. Examination record of reduced work capacity of the Medical Assessment Council.

5. Written request for settlement of occupational accident benefits.

6. Designation of medical examination and treatment establishments, orthopedic and functional rehabilitation establishments according to regulations on provision of means of living (if any).

- Dossier for settlement of occupational accident benefits for the employee whose treatment is completed after being discharged from hospital from July 1, 2016 according to regulations includes:

1. Hospital discharge sheet or a copy of the medical record after the completion of inpatient treatment for occupational accidents.

2. Minutes of the Medical Assessment Council concluding the degree of work ability decrease.

3. Written request for settlement of occupational accident benefits. (Form No. 05A-HSB issued together with Decision No. 166/QD-BHXH dated January 31, 2019 of Vietnam Social Security)

4. In case of payment of medical examination fees: additional invoices, vouchers of examination fees, and a list of the assessment contents of the establishments performing the medical assessment.

5. Designation of medical examination and treatment establishments, orthopedic and functional rehabilitation establishments according to regulations on provision of means of living (if any).

As you did not specify the time when the employee at your unit had an occupational accident and was discharged from hospital, you should base on the above provisions to specify the dossier for the settlement of the occupational accident regime.

If the employee in your unit had an occupational accident and discharged from the hospital from July 1 2017 or onwards, the social insurance agency still requires documentation procedures beyond the above-mentioned documents. Please send information about your unit and the social insurance agency where your unit pays the social insurance premium to VSS for consideration and settlement in accordance with the regulation.
