Question from Nguyen Thi Hieu from Lai Chau province: I submitted my retirement dossiers to the social insurance agency, but the agency returned the documents as my social insurance was not paid following the State’s prescribed salary regime. I was requested to ask my company to make adjustments. However, all my ex-companies have been dissolved, so what agency should I find to request for the adjustments?
Answer from the Vietnam Social Security:
Under Article 18 and Clause 1 of Article 94 of the Social Insurance Law 2006; Clause 1 of Article 89 of the Social Insurance Law 2014; and Point 2.1, Point 2.2 of Clause 2 of Article 3 on the collection process of social, health, unemployment, labour accident, and occupational disease insurance; as well as regulations on the management of social and health insurance record books issued together with Decision No.595/QD-BHXH on April 14, 2017 by the general director of the Vietnam Social Securities: if a labourer works for a definite term and has paid social insurance at an agency subjected to the State’s prescribed salary regime, but she/he did not get paid at the proper salary level regulated by the State while the agency was dissolved or terminated its operation, the current agency employing the labourer and the labourer should coordinate with the office that directly managed the dissolved agency to make adjustments to the labourer’s salary to match regulations of social insurance payment.
