Does the enterprise pay social insurance premiums for employees with seasonal contracts?
According to the 2014 Law on Social Insurance, effective from 1 January 2016, Point b, Clause 1 of Article 2, the employees required to participate in social insurance are: "b) Person working under labor contracts that have a term ranging from one month to less than three months. " However, Clause 1 Article 124 of the 2014 Law on Social Insurance specifics the effect of implementing of the provisions stated on Point b, Clause 1 of this Law that they will be taken into effect from January 1, 2018. Therefore, in 2016 and 2017, enterprises which sign labor contracts with employees in a term ranging from one month to less than three months still do not have to pay social insurance premiums for employees but from 2018 they will be forced to pay social insurance premiums for all their employees with a 1-month onward labor contract.
