The Government issues the Plan to implement the Law on Social Insurance and Resolution No. 142/2024/QH15

Deputy Prime Minister Ho Duc Phoc has just signed the Decision No. 1370/QD-TTg on promulgating the Plan to implement the Law on Social Insurance and the Resolution No. 142/2024/QH15 of the National Assembly.

On June 29, 2024, at the 7th Session, the National Assembly (NA) passed the Law on Social Insurance No. 41/2024/QH15, shall take effect from July 1st, 2025, and issued Resolution No. 142/2024/QH15 of the 7th Session, 15th NA. To implement the Law on Social Insurance and the Resolution No. 142/2024/QH15 in a timely, synchronous, unified and effective manner, the Prime Minister has issued a Plan to implement the Law on Social Insurance and the Resolution No. 142/2024/QH15.

The purpose of the Plan is to implement the tasks assigned by the National Assembly to the Government, the Prime Minister, and the Ministers at the Law on Social Insurance and the Resolution No. 142/2024/QH15; raise awareness on the Law on Social Insurance; conduct the implementation of the Law on Social Insurance and the Resolution No. 142/2024/QH15 so as to ensure timeliness, synchronization, unity, effectiveness and efficiency.

At the same time, specify the contents of work, deadline, completion progress and responsibilities of relevant agencies and organizations in the process of implementing the Law on Social Insurance and the Resolution No. 142/2024/QH15; determine the responsibilities and coordination mechanism between ministries, ministerial-level agencies, government agencies and localities in carrying out activities to implement the Law on Social Insurance and the Resolution No. 142/2024/QH15.

The contents of the Plan include: Conducting propaganda, dissemination and training on the Law on Social Insurance and documents on guiding its implementation; conducting specialized training and professional improvement for social insurance office staffs, staffs who are now working in the fiels of social insurance in the Labor - Invalids and Social Affairs sector, trade unions, service organizations authorized by social insurance offices  and the subjects who are directly implementing social insurance policies.

The Ministry of Labor, War Invalids and Social Affairs shall coordinate with the Vietnam Social Security (VSS) and relevant agencies to compile documents serving the dissemination of the Law on Social Insurance and guidance documents  on its implementation; training documents, professional improvement in implementing social insurance policies and laws.

Ministries, ministerial-level agencies, People's Committees of provinces and centrally-run cities, based on their functions and tasks, review legal documents related to the Law on Social Insurance under their assigned state management authority; according to their authority, implement or propose to competent authorities to promptly amend, supplement, replace, abolish or issue new legal documents to ensure compliance with the provisions of the Law on Social Insurance and related detailed legal documents and implementation instructions.

Ministries shall develop, promulgate or submit to competent authorities for promulgating documents on providing regulations on implementing the Law on Social Insurance as assigned at  the Decision No. 717/QD-TTg dated July 27th, 2024 of the Prime Minister on  promulgating the List and assigning agencies to preside over drafting documents detailing the implementation of laws and resolutions passed by the 15th National Assembly at the 7th Session...

Social insurance is a crucial social welfare policy of the State and Government of Vietnam, designed to ensure income security for participants when they experience a reduction or loss of income due to illness, sickness, occupational accidents, and other circumstances. 
Social insurance is a guarantee to replace or partially compensate for the income of workers when they experience a reduction or loss of income due to illness, maternity, occupational accidents, occupational diseases, retirement, or death, based on contributions to the social insurance fund. (According to Clause 1, Article 3, Law on Social Insurance 2014).

In this context, 'Insurance' is a means of protection against financial losses. It is a form of risk management, primarily used to safeguard against unforeseen or potential losses. 'Society,' on the other hand, refers to a group of individuals who regularly engage in social interactions or a large social group sharing a common spatial or social territory, often governed by the same political authority and subject to prevailing cultural expectations.
Thus, social insurance is a social welfare policy organized by the State and ensured by the Vietnam Social Insurance agency in accordance with the law. There are two forms of participation in social insurance corresponding to two types of social insurance:

Mandatory social insurance.
Voluntary social insurance.
According to Article 4 of the Law on Social Insurance 2014, social insurance in Vietnam includes the following five regimes:

Sickness benefits.
Maternity benefits.
Occupational accident and disease benefits.
Retirement benefits.
Survivorship benefits.
Participants in mandatory social insurance are entitled to all five benefits listed above. Meanwhile, participants in voluntary social insurance are eligible for only two regimes: retirement benefits and survivorship benefits. Additionally, for special groups receiving State support for social insurance contributions, they are entitled to supplementary retirement benefits as prescribed by the Government in Clause 7, Article 3 of the Law on Social Insurance.
Social insurance participants are entitled to benefits under the social insurance regimes through monthly allowances or lump-sum payments. In cases where participants choose not to continue contributing to social insurance, they may either preserve their previous contribution period or withdraw a one-time social insurance benefit. The benefit amount is calculated based on the monthly salary used for social insurance contributions and the duration of contribution."
