Many contents on 2023’s Decree 70 create favorable condition for foreign labors in Vietnam.

Specifically, foreign expert must have collegue degree or more and at least three-professional experience years suitable with planned position in Vietnam. The previous regulation on BA certificate suitable with professional duty.

Technical foreign labors need to be educated for one year and more and at least three-professional experience years suitable with planned position in Vietnam in stead of the right profession  reggulated on Decree 152 in 2020.

From Jan 1^st 2024, the Vietnamese labor recruitment’s notification for the planned positions must be notified for at least 15 days since being informed with The Ministry or Department of Labour, War Invalids and Social Affairs.

The declaration on MOLISA’s portal (Department of Employment) or Centre of Employment Service Centre’s Portal is decided by  provincial People’s Committee.

 In case foreign labor working for one employer at many locations, all locations must be listed on document on labor certificate requirement. 

 MOLISA unifies state management on recruitment, foreign labor over the country as well as management of Vietnamese working for foreign individuals, organizations in Vietnam. 

 The Decree aboilishes the content “issue, reissue, revoke, extend work permits and certifying that foreign workers are not subject to work permits for foreigners working in industrial parks and economic zones in Decree 35/2022. 

 Accordingly, the Department of Labour, War Invalids and Social Affairs shall unify foreign labor management in the local.

 Decree 70/2023/NĐ-CP shall take effect from Sept 18th 2023.
