VSS General Director issues a Directive on task performance of the Vietnam's social insurance industry in the new normal

In the context of the COVID-19 epidemic in the country and the world undergoing complicated and unpredictable developments; in order to further improve the service quality for participants and beneficiaries of social, health and unemployment insurance policies; On July 21, 2021, General Director of Vietnam Social Security (VSS) Nguyen The Manh issued Directive No. 2165/CT-BHXH on strengthening the responsibility of the head of the unit in the observance of administrative discipline and corruption prevention, public service ethics, code of conduct, reform of administrative procedures, coordination in the organization and performance of tasks in the new situation of Vietnam's social insurance industry.
The directive states: Over the past time, the whole Vietnamese social insurance industry has made constant efforts to implement the guidelines and policies of the Party and the State on social, health and unemployment insurance, Resolution, Directives of the Government and the Prime Minister (PM) on the main tasks and solutions to improve the business environment, enhance national competitiveness, promote administrative reform, and prevent corruption, switching the working style from administrative to service, towards peace of mind, trust and satisfaction of people, organizations and enterprises in the implementation of social, health and unemployment insurance policies, achieved positive results in the implementation of political tasks assigned by the Party and State.
However, a number of units and individuals under the Vietnam's social insurance system at some point in time have not been drastic enough and passive in directing and administering, leaving backlog work, overdue, and pushing responsibilities, lack of inspection and prompting lead to errors, easily leading to negativity in the performance of official duties. There is still a lack of unity, locality, and low efficiency in task coordination and resolution (inside and outside the sector), which occurs in a number of agencies and units in the Vietnamese social insurance system. The main reason is that the heads (including the deputy heads) of some units in the system have not fully performed their responsibilities in managing and educating employees under their authority; the inspection of public affairs has not been regularly concentrated on, the responsibility to set examples and being exemplary has not been promoted, even in some places there are signs of covering up and tolerating wrongdoings, violating the law in the performance of duties.
In order to overcome the limitations and weaknesses, and create clear changes in the coming time, especially in the context of the COVID-19 epidemic in the country and the world undergoing complicated and unpredictable developments, it is necessary to further improve the service quality for participants and beneficiaries of social, health and unemployment insurance policies; The VSS General Director requested:
1. The heads (including the deputy heads) of the units under the VSS System, especially the heads of the units under the VSS, the Directors of the Social Security Administrations of the provinces and cities directly under the Central Government, Directors of social security agencies at the district and town levels (hereinafter referred to as district-level) under the social security authorities of provinces and centrally-run cities shall strengthen roles and responsibilities in management, direction and administration according to their competence, strictly observe discipline and administrative discipline, and prevent and fight against corruption, negativity, wastefulness, and implement public service ethics, working style and manners at agencies and units, reform of administrative procedures, civil service regimes and civil servants, associated with improving the spirit of coordination (inside and outside the sector) in organize the performance of tasks, personalize responsibility for limitations, existence, and law violations under the management responsibility if there is laxity or lack of responsibility in management and administration.

2. Heads of units directly under the VSS, Directors of social security agencies of provinces and centrally run cities, and directors of district-level social security agencies under social security authorities of provinces and centrally run cities shall focus on directing the strict implementation of the following contents:
a) To continue to strictly implement the publication, update and publicize administrative procedures to ensure compliance with regulations on timeliness, completeness, accuracy, consistency and transparency, creating maximum convenience for the people, organizations, and enterprises. To promptly receive and handle and fully respond to complaints and suggestions from people and businesses about difficulties in the implementation of social insurance, health insurance and unemployment insurance regimes and policies falling under the management of the unit and report on matters falling under the jurisdiction of the VSS.
b) To raise responsibility in leading and directing the implementation of strengthening administrative discipline, public service ethics, code of conduct of the Sector; strictly comply with the law on office culture; preventing the situation of civil servants and public employees under their management from showing bossy attitudes, causing troubles to people, organizations and enterprises in the course of performing their duties and public services.
c) To continue to review and supplement internal rules, regulations and working procedures of the unit in order to increase the sense of discipline observance, work discipline, office culture, public service ethics, and behavior rules, effectively using working time and assigning tasks to appropriate people, jobs, responsibilities, and results of civil servants, public servants and employees under their management.
d) To strictly implement the regulations on management and decentralization of management for civil servants, public servants and employees of the Sector. To strictly handle those who commit acts of negativity, corruption, wastefulness, harassment, causing troubles to people, organizations and enterprises. At the same time, to hold the responsibility before the Party Committee, the VSS General Director, and before the law for violations committed by civil servants, public servants and employees under their management if there is laxity or lack of responsibility in management and administration.
dd) To lead and direct the units to complete the key targets, plans and tasks of the Sector at the agency or unit in charge; definitively settle the outstanding and overdue work; actively coordinate with units inside and outside the industry in organizing the implementation of tasks, without pushing the assigned responsibilities.
e) Regarding the implementation of directing and executive measures in order to both fulfill political targets and tasks, ensure the prevention and control of the COVID-19 epidemic and seriously and effectively implement the Resolution No. 68/NQ-CP dated July 1, 2021 of the Government and Decision No. 23/2021/QD-TTg of July 7, 2021 of the PM on a number of policies and implementation of a number of supporting policies for employees and employers facing difficulties due to the COVID-19 pandemic: Heads of units under the VSS, Directors of Social Security Administrations of provinces and centrally-run cities, Directors of district-level social security agencies of provinces and centrally-run cities must take the initiative in formulating scenarios and operating plans to organize and perform tasks flexibly and appropriately in accordance with the direction of the Government, the PM, the VSS General Director, and local authorities. To take responsibility before the General Director if there are cases of delay, trouble or illegal settlement within its competence in the implementation of a number of policies to support employees and employers hit by the COVID-19 pandemic.
Heads of units under the VSS system shall be responsible according to regulations if the civil servants, public servants, and employees in their agencies or units are COVID-19 positive and fail to comply with regulations on COVID-19 prevention and control due to negligence or subjectivity.
g) To step up the inspection and examination of official duties in order to promptly correct violations and strictly handle according to law provisions for civil servants, public servants and employees who violate regulations and professional processes, code of conduct, professional ethics, harassment, indifference, insensitivity in the process of performing official duties; focus on the protection of internal politics, especially the planning, appointment and rotation of cadres must ensure the correct political standards, procedures, and principles in order to proactively prevent negative consequences internally and strengthen the assurance of unity and purity within the unit, timely reward civil servants and employees with achievements; strictly and objectively discipline those who violate in accordance with law.
3. To assign the Department of Organization and Personnel to assume the prime responsibility for, and coordinate with relevant units in, monitoring, inspecting and urging the implementation of the Directive.
4. Heads of units affiliated to VSS, Directors of social security agencies of provinces and centrally run cities, Directors of district-level social security agencies under social security authorities of provinces and centrally run cities shall be responsible for disseminating information towards all civil servants, public servants and employees and strictly implement this Directive.
