Problem solving regarding compulsory social insurance for workers at Commune People's Committees

The Government Office has just issued Notice No. 108/TB-VPCP on the conclusions of Deputy Prime Minister Vu Duc Dam at the meeting to resolve problems in the implementation of compulsory social insurance at the Commune People's Committees.

Accordingly, currently, the Deputy Military Commanders, Deputy Chiefs of Public Security and people working under labor contracts at Commune People's Committees are facing numerous problems in handling procedures for enjoying compulsory social insurance.

Therefore, in this Notice, the Deputy Prime Minister agreed with the proposal of the Ministry of Home Affairs and opinions of the ministries and agencies on the plan to handle problems in the implementation of compulsory social insurance for the above subjects as follows:

- For Deputy Military Commanders and Deputy Chiefs of Commune Police who have been working from November 2003 until present: If they have contributed to compulsory social insurance, they will be entitled to social insurance benefits when eligible or have their time reserved of contributing to compulsory social insurance under the current Law on Social Insurance.

- Employees whose labor contracts are signed by the Commune People's Committees for a full 03 months or more and have paid compulsory social insurance and the salary as the basis for payment is the salary stated in the labor contract according to the regime set by the employer: To be entitled to social insurance benefits if eligible or have their time reserved of contributing to compulsory social insurance according to regulations.

At the same time, the Deputy Prime Minister assigned the Ministry of Justice to have an official written opinion on the authority to decide the above-mentioned handling plan and send a report by May 20, 2021. After that, the Ministry of Home Affairs shall receive and complete the report and submit it to the competent authority.
