“Although this is the new assigned duty, VSS industry showed the great effort to well deploy; constantly research and summarize practices to further enhance the actual efficiency”-  said Deputy General Director Le Hung Son. However, according to Son, this content needs the foundation of deep legal knowledgement; meanwhile, the deployment has been affected by Covid-19 pandemic in 2 recent years. This situation makes VSS as well as social and health insurance contribution specialized inspection groups have some certain limitations.

Especially, the role of social insurance contribution specialized inspection is emphasized, which shall directly affect collection and participant expanse, reduce delayed and evaded social insurance payment. Therefore, with the spirit “fix the weakness”, VSS leader required units to early overcome the limitations, especially administrative violations on social and health insurance payment; to strengthen deterrence, enhance awareness on employers’social and health  law execution.

 In term of the training content, General Director Son required representatives to concentrate on reinforcing basic knowledge on handling administrative violations on the basis of absorbing new points in newly issued legal documents. At the same time, the professional qualifications of civil servants in charge of inspectation in provincial social insurace offices is improved; help the civil servants grasp, be proficient in the skill of making sanctioning documents, records of administrative violations, issuing sanction decision, enforcing execution…

“To require civil servants attending the training conferrence to concentrate listening, grabsing the content, equiped skills; strengthen interaction, exchange to know well araised difficulties in reality. This is the basis for enhancing implementation efficiency in practice” – said Son.

At the conference, Dang Thanh Son – Director of the Department of Management of Handling of Administrative Violations and Monitoring of Law Implementation (Ministry of Justice) popularized basic contents, new points on administrative violations in the Law No 67/2020/QH14 on amending and supplementing some articiles in Law on Handling of Administrative Violations No 15/2012/QH13; Decree No 118/2021/NĐ-CP

Accordingly, Law No 67/2020/QH14 revised, supplemented 66/142 articles (16 articles were fully revised, supplemented); 11/142 articles were revised technically; 4 articles were revised, 3 articles of Law No 15/2012/QH13 were abrogated. In term of handling administrative violations, Law No 67/2020/QH14 revised and supplemented the following contents: Increase maximum fine level for some fields; amend, supplement regulations related to authority on handling administrative violations; execute and force to execute decision on handling administrative violations… At the same time, the regulations relating to subjects and conditions applying methods on handling administrative; methods on preventing and ensuring to handle administrative violations… were modified.

Decree No 118/2021/NĐ-CP regulates detailedly some articles and solutions on executing Law on handling of administrative violations. VSS’ responsibility is supplemented at Article 37. Particularly, as ministries, ministerial-level agencies, VSS has responsibility for building and completing law on handling administrative violations; implement statistics on handling admistrative violations; do statistics, report on carying out law on handling administrative violations; build database on handling administrative violations; inspect the situation of executing law on handling administrative violations under authorities; popularize, train, improve knowledge on applying law on handling administrative violations; build material facilities, consolidate organization, arrange human resource to implement law on handling administrative violations.

Dang Thanh Son also exchanged, answered the representatives’ questions on worry, difficulties in practice, at the same time shared exeperience on handling administrative violations. “Grasping knowledge, mastering skills on applying law shall help civil servants strengthen their professionalism, minimize errors in enforcing the law in general and sanctioning administrative violations in particular. Thí important solution contributes to enhance effectiveness, efficiency on implementing policies, law on social insurance, health insurance”-emphasize Son.
