Position and functions

1. Vietnam Social Security is a Government-attached agency and has the functions of organizing the implementation of social and health insurance policies; organizing the collection and payment of unemployment insurance money; managing and using funds: social insurance funds, unemployment funds and health insurance funds; inspecting the payment of social insurance, unemployment insurance and health insurance in compliance with the law.

2. Vietnam Social Security has an international transaction name in English as Viet Nam Social Security, abbreviated as VSS.

3. Vietnam Social InsurancE is under the management of the Ministry of Labour, War Invalids and Social Affairs in terms of social and unemployment insurance; of the Ministry of Health and the Ministry of Finance in terms of financial mechanism of social insurance, unemployment insurance and health insurance funds.

Tasks and power

1. Proposing the Ministry of Labour – Invalids and Social Affairs (MOLISA) to submit to the Government prescribing the functions, duties, power and organizational structure of Vietnam Social Security.

2. Developing and submitting proposals of strategies, long-term plans, five-year plans, annual plans and other projects and schemes of the Vietnam Social Security under the authority of the Government and Prime Minister and organize the implementation of those strategies, plans, projects and schemes once they are approved.

3. Organizing the implementation of policies on social insurance, unemployment insurance and health insurance:

a) Promulgating guiding documents on procedures, expertise and profession in the settlement of regimes and policies on social insurance and health insurance; revenues and expenditures of social insurance, unemployment insurance and health insurance; on specialized inspection of payment of social insurance, unemployment insurance and health insurance in accordance with the law; promulgating specific documents and internal management documents of Vietnam Social Security;

b) Considering and settling the calculation of working time for employees who no longer have original documents showing working time in the state sector before January 1, 1995 under the guidance of the Ministry of Labour, Invalids and Social Affairs;

c) Organizing communication, propagation and dissemination of regimes, policies and laws on social insurance, unemployment insurance and health insurance;

d) Identifying, exploiting and managing participants of social insurance, unemployment insurance and health insurance; exploiting, registering and managing participants of social insurance, unemployment insurance and health insurance participants according to the provisions of law;

đ) Promulgating forms of social insurance and health insurance cards, social insurance and unemployment insurance dossiers, and issuance of social insurance and health insurance cards for participants in accordance with the law;

e) Collecting or authorizing service organizations to collect social insurance, unemployment insurance and health insurance premiums of agencies, units, organizations, employers and individuals in accordance with the law. Receiving funds transferred from the State budget to spend on social insurance and health insurance regimes according to the provisions of law;

g) Receiving dossiers and handling sickness and maternity benefits; occupational accidents and diseases; pension; survivorship; convalescence and recovery after sickness, maternity and after treatment for occupational accidents and diseases; medical examination and treatment according to the provisions of law;

h) Organizing or authorizing service organizations to the payment of social insurance, unemployment insurance and health insurance regimes in accordance with the law;

i) Organizing to sign contracts with medical examination and treatment establishments meeting all conditions and professional and technical standards; examining and supervising the performance of the health insurance contract for medical examination and treatment; organizing health insurance assessment according to the provisions of the health insurance law; protecting the interests of the health insurance participants and combating abuse and self-seeking purposes of health insurance regimes;

k) Checking the contribution and refund of social insurance, unemployment insurance and health insurance premiums for agencies, units, employers and individuals; refusing payment and claiming requests of social insurance, unemployment insurance and health insurance regimes in contravention of the provisions of law;

l) Archiving records of participants and beneficiaries of social insurance, unemployment insurance and health insurance regimes in accordance with the law;

m) To take measures to limit payment evasion and late payment of social insurance, unemployment insurance and health insurance;

n) Fully and promptly providing information on the payment and the right to enjoy the benefits of social insurance, unemployment insurance and health insurance at the request of the employee, the employer or the group union. Fully and promptly providing relevant documents and information at the request of the competent state agency.

4. On management and use of social insurance, unemployment insurance and health insurance funds:

a) Managing and using social insurance funds, including: Retirement and survivorship fund, insurance fund for occupational accidents and diseases; sickness and maternity fund; unemployment insurance fund; health insurance fund on the principle of centralization, consistency, publicity, transparency as prescribed by law; organizing the accounting of social insurance, unemployment insurance and health insurance funds according to the provisions of law;

b) Annually formulating and organizing the implementation of investment plans for the social insurance, unemployment insurance and health insurance funds once approved by the Governing Body of Vietnam Social Security; managing investment risks of social insurance, unemployment insurance and health insurance funds in accordance with the law.

5. In terms of the performance of other duties on social insurance, unemployment insurance and health insurance in accordance with the law:

a) Directing and providing professional guidance to the Ministry of National Defence Social Insurance and the Social Insurance of Ministry of Public Security; the Ministry of National Defence Social Insurance coordinating with the Social Insurance of Ministry of Public Security in managing the implementation of social insurance and health insurance in the Ministry of National Defence and the Ministry of Public Security;

b) Providing professional training and guidance on social insurance, unemployment insurance and health insurance;

c) Deciding and organizing the implementation of the administrative reform plan of Vietnam Social Security according to the Government's administrative reform objectives, requirements, programs and plans and the Prime Minister's directions; implementing the joint one-stop mechanism in settling social insurance, unemployment insurance and health insurance regimes;

d) Organizing electronic transactions in the field of social insurance, unemployment insurance, health insurance in accordance with the law;

đ) Organizing the implementation of support, answers and advice on legal policies on social insurance, unemployment insurance and health insurance;

e) Settling complaints and denunciations about social insurance, unemployment insurance and health insurance according to the provisions of law; initiating a civil lawsuit to request the court to protect the public interests and state interests in the fields of social insurance, unemployment insurance and health insurance. When detecting acts showing signs of crime in the fields of social insurance, unemployment insurance and health insurance in accordance with the Penal Code, the agency shall send a written petition for prosecution enclosed with evidences and documents related to competent procedural authorities for consideration and prosecution in accordance with the law.

6. Specialized inspection of social insurance, unemployment insurance and health insurance payment; sanctioning administrative violations in the domain of payment of social insurance, unemployment insurance and health insurance according to the provisions of law.

7. Implement international cooperation on social insurance, unemployment insurance and health insurance in accordance with the law; implement bilateral and multilateral agreements on social insurance within the scope of functions and tasks of the social insurance industry according to regulations.

8. On the organizational structure, finance, assets:

a) Managing organizational apparatus, civil servant payrolls, employment vacancy and public employee structure by professional titles and number of people working in public non-business units; making decisions on rotation, retirement, transfer, appointment, dismissal, commendation, discipline, and policies on the training and retraining of cadres, civil servants and public employees; recruiting, using and salary regimes for cadres, civil servants and public employees within their competence according to the provisions of law;

b) Managing finance and assets of the Vietnam Social Security system and organizing the statistical and accounting work on social insurance, unemployment insurance and health insurance in accordance with the law;

c) Performing internal audit of units under the Vietnam Social Security system in accordance with the law and internal audit regulations of the units;

d) Implementation of emulation and commendation work for the units of the Vietnam Social Security system.

9. Organizing scientific research and application; applying information technology in statistics and management of social insurance, unemployment insurance and health insurance.

10. Submitting reports every six months to the Governing Body of Vietnam Social Security on the implementation of social insurance, unemployment insurance and health insurance. Complying with the regime of reporting to the Government, the Prime Minister, the Ministry of Labour, War Invalids and Social Affairs, the Ministry of Finance and the Ministry of Health in accordance with the law.

11. Performing other tasks and powers assigned by the Government and the Prime Minister and according to the provisions of law.
